RETAIL DEALER – As used in this article, means any persons, firm, corporation, association or concessionaire who sells, distributes or dispenses, at retail, any low-point beer within the corporate limits of the City of Weatherford, without regards as to any place where such beverages may be consumed or used. (Reference: Title 37, 1991 O.S., Section 163.2.)

LOW-POINT BEER – Is defined to mean all beverages containing more than 1/2 of 1% alcohol by volume, and not more than 3.2% alcohol by weight.
1. 
There is hereby levied upon each retail dealer of low-point beer for consumption on and off the premises, an annual municipal license fee of $20; an annual license fee of $10 is hereby levied upon each retail dealer for sale of low-point beer for consumption off the premises only. (Reference: Title 37, 1991 O.S., Section 163.10; see e.g., Title 37 O.S., Section 163.7(c).)

It shall be unlawful for any retail dealer, whether permanent or temporary, to sell, distribute or dispense any low-point beer without having first received a municipal occupation license, as herein required.
3. 
No municipal occupation license shall be issued to any retail dealer by the City Clerk, until the applicant has obtained all required State and County permits. All such occupation licenses shall expire on June 30th of the year following reissuing. License fees shall be paid to the City Clerk and no license shall be transferable from one person to another. (Reference: See e.g., Title, 1991 37 O.S., Section 163.8.)
4. 
The Weatherford Board of Commissioners shall have the power, after public hearing, to revoke any license granted hereunder for violation of law or ordinance by the license holder.
It shall be unlawful for any person, firm, or corporation operating or maintaining a place of business where low-point beer is sold for consumption on the premises to:
1. 
Sell, offer for sale, give away, procure for, or otherwise dispense to, any person under 21 years of age any low point beer; (Reference: Title 37, 1991 O.S., Section 163.11(3).)
2. 
Permit any person under 21 years of age to loiter or remain in or around such place of business, except where such business is an eating place where the service of such beverages is incidental to the main business of serving food, unless said person's parent or legal guardian is present. (Reference: Title 37, 1991 O.S., Section 241; see also Title 37 O.S., Section 163.11(4).)
3. 
Employ any person under 21 years of age to work in such a place, except where said place is an eating place where the service of such beverages is incidental to the main business of serving food. (Reference: Title 37, 1991 O.S., Section 243.)
4. 
Sell, deliver or knowingly furnish low-point beer to an intoxicated person or to any person who has been adjudged insane or mentally deficient; (Reference: Title 37, 1991 O.S., Section 538.G.)
5. 
Permit therein gambling, betting or operation of a lottery; (Reference: Title 37, 1991 O.S., Section 163.11(6).)
6. 
Permit sale, furnishing or drinking of intoxicating liquor; or (Reference: Title 37, 1991 O.S., Section 163.11(7).)
7. 
Permit disorderly conduct, loud or disturbing language or any other violation of state law or of the Code of Ordinances of the City of Weatherford.
It shall be unlawful for retail dealers who sell low-point beer for consumption on the premises to be located within 300 feet from any public school or church; provided however that, if any public school or church shall be established within 300 feet of any such retail dealer, license renewal shall not be affected adversely so long as there has not been a lapse of more than 60 days. (Reference: Title 37, 1991 O.S., Section 163.24.)
It shall be unlawful and a criminal offense for low-point beer (as herein defined) to be sold, given away or otherwise dispensed for consumption on the premises between the hours of 2:00 a.m. and 7:00 a.m. on any day, except Saturday nights, when such beverages may not be sold between the hours of 2:00 a.m. and 12:00 noon on Sunday.
