Any user who is found to have violated an order of the Director
of Water Resources, or who willfully or negligently failed to comply
with any regulation or permit issued hereunder, shall be fined in
the Municipal Court of the City of Weatherford, not less than $500
plus costs, nor more than $1,000 plus costs, for each offense. Each
and every day on which a violation shall occur or continue shall be
deemed as a separate and distinct offense. In addition to the penalties
provided herein, the city may recover reasonable attorney fees, court
costs, and other expenses of litigation by appropriate suit at law
or in equity against the person found to have violated this Chapter
or any order, rule, regulation, or permit issued hereunder. However,
any user who notifies the Director of Water Resources or his designated
representative of any accident or discharge within 24 hours of the
accident and prior to the independent discovery of said discharge
by the city shall be fined not more than $250 plus costs.
