There is hereby created, authorized and established the Recreation Commission, which said Commission shall consist of three members who shall be appointed by the Board of Commissioners of the Borough for staggered three year terms from January 1 of the year of their appointment.
A. 
Upon their appointment, the members shall meet and select a Chairman. The members shall select a secretary who shall not be a voting member of the Recreation Commission and who shall, subject to the approval of the Board of Commissioners of the Borough of Wildwood Crest, be approved and paid in accordance with the provisions of the existing Salary Ordinance of the Borough of Wildwood Crest.
B. 
Said Recreation Commission shall meet on the first Wednesday of every month, and the first Wednesday of February shall be the annual reorganization meeting.

The powers, duties and authority of said Recreation Commission shall be to regulate, govern and supervise the recreation and athletic parks now in said Borough or hereafter established therein and to beautify the same; to regulate, govern and supervise all athletic games, civic amusements, entertainments or enterprises and undertakings or events to be held in or upon any recreation parks, playgrounds, piers, athletic fields or swimming pools; to arrange and provide for the giving of outdoor and indoor exhibitions, concerts, games, entertainments, dances and contests therein and thereon; and the power and authority to use and employ said playgrounds or recreation places for the purposes of giving therein and thereon outdoor exhibitions, concerts, games, entertainments, dances and contests. Said Commission shall have the power and authority to charge and collect a reasonable admission fee for each person entering such playground or recreation place during the time or times when the same is being used or employed for such purposes; provided, however, that such power and authority before being in any way exercised by said Recreation Commission shall be first subject to the approval and confirmation of said Board of Commissioners of said Borough. Said Recreation Commission shall have the power to establish, charge and collect reasonable fees, rents or other charges for admission to or use or enjoyment of the Borough swimming pool; provided, however, that such fees, rents or other charges shall be subject to the prior approval of the Board of Commissioners. Said Recreation Commission shall have the power to establish, charge and collect reasonable fees for the sale of merchandise with the Borough's trademarks or insignia to the public; provided, however, that such fees shall be subject to the prior approval of the Board of Commissioners.
A. 
The specific fee for any activity, event, or purpose, as set forth herein by a "not to exceed" amount, may be individually set from time to time by resolution of the governing body.
B. 
For the lease of Borough property, each individual, in addition to the payment of the requisite fee and execution of the necessary hold harmless agreement as required for participation in Borough sponsored recreation events and activities, shall be required to execute a lease and provide proof of adequate insurance coverages with sufficient policy limits as determined by the Borough.
C. 
The Schedule of Fees, referred to herein is included as an attachment to this chapter.
The Board of Recreation Commissioners may make such rules and regulations for the above-named purposes as it may determine, but the same shall be submitted to and approved by the Board of Commissioners of this Borough before they become in any way operative or effective.
The members of the said Recreation Commission shall serve during their appointment without any fees, salary or compensation whatsoever.
Any vacancy existing during the term of any member thereof shall be filled by the Board of Commissioners of the said Borough.
Should any section, paragraph, sentence, clause or phrase of this ordinance be declared unconstitutional or invalid for any reason, the remaining portion of this ordinance shall not be affected thereby and shall remain in full force and effect, and to this end the provisions of this ordinance are hereby declared to be severable.
All ordinances in conflict or inconsistent with this ordinance are hereby repealed, to the extent of such conflict or inconsistency.
This ordinance shall take effect on its final passage and publication as provided by law.
