Whenever any words and phrases are used in this chapter, the
meaning respectively ascribed to them in Subtitle 1 of Title 39 of
the Revised Statutes of New Jersey shall be deemed to apply to such
words and phrases used herein.

Whenever certain hours are named in this chapter, they shall
mean either Eastern Standard Time or Eastern Daylight Saving Time
as may be in current use in the borough.

The provisions of this chapter imposing a time limit on parking
shall not relieve any person of the duty to observe other more restrictive
provisions prohibiting or limiting the stopping, standing or parking
of vehicles as set forth in R.S. 39: 4-138, any other New Jersey statute
or as hereinafter provided.

a.
Upon the declaration of an emergency, there shall be no parking upon
streets or sections of streets where temporary EMERGENCY-NO PARKING
signs are displayed. The chief of police or, in his absence, the ranking
police officer is authorized to declare an emergency and to direct
the posting of EMERGENCY NO PARKING SIGNS when weather conditions,
accidents, fires or public celebration dictate or require the avoidance
of hazards or other conditions which interfere with the free flow
of traffic. Notification that EMERGENCY NO PARKING signs are being
or will be posted shall be given to the operator or owner of any vehicle
which has been parked prior to the posting of the signs.
b.
Any unoccupied vehicle parked or standing in violation of this section
shall be deemed a nuisance and a menace to the safe and proper regulation
of traffic and any police officer may provide for the removal of such
vehicle. The owner shall be liable for the reasonable costs of removal
and storage which may result from such removal before regaining possession
of the vehicle.
c.
The effectiveness of this subsection is contingent upon the signs
being erected as required by law.

No person shall park a vehicle at any time upon any of the streets or parts thereof described in Schedule I of Chapter 7A.

No person shall park a vehicle between the hours specified in Schedule II of any day (except Sundays and public holidays) upon any of the streets or parts of streets described in Schedule II of Chapter 7A.

No person shall stop or stand a vehicle between the hours specified in Schedule III of any day (except Sundays and public holidays) upon any of the streets or parts of streets described in Schedule III of Chapter 7A.

No person shall park a vehicle for longer than the time limit shown in Schedule IV at any time between the hours listed in Schedule IV of any day (except Sundays and public holidays) upon any of the streets or parts of streets described in Schedule IV of Chapter 7A.

a.
Parking Facilities Mandated:
1.
Parking stalls for handicapped persons are hereby established in
accordance with N.J.S.A. 52:32-4 et seq.; N.J.S.A. 40:48-2.46 and
N.J.S.A. 39:4-197, 4-204, 4-206, and 4-207.
2.
The parking stalls established in paragraph 1 above shall conform
to the requirements mandated by N.J.S.A. 52:32-12; N.J.A.C. 17:19A-4.4(A),
(B), (C), (D) and (E), and the same are incorporated herein by reference.
b.
Establishment; Violations and Penalties:
1.
There are hereby established restricted parking spaces for handicapped
persons who display official state handicapped license plates or special
identification stickers issued by the Motor Vehicle Commission or
the Borough of Union Beach at the locations indicated in Schedule
XVIII in accordance with the provisions of N.J.S.A. 39:4-205 and 4-206.
2.
Any person who parks a motor vehicle in a restricted parking stall
reserved for handicapped persons that does not display the official
state handicapped license plate, or special identification sticker
from the Motor Vehicle Commission or the Borough of Union Beach, shall
be presumed to have parked in said restricted parking stall unlawfully.

Unless any other provisions of this chapter and its included
schedules prohibit parking on a particular street or side of a street,
permit parking in front of private driveways shall be authorized as
follows:
a.
The Union Beach Police Department shall issue permits to owners of
private driveways and to members of the same household as the owner
of a private driveway, provided that an application for a permit has
been completed and filed with the appropriate fee on a form provided
by the borough clerk.
b.
The permit shall allow parking solely in front of the private driveway
so identified in the application.
c.
The owner of the private driveway shall be eligible to apply for
up to three permits for his own vehicles or for use by others authorized
by the owner to park in front of the private driveway.
d.
Each member of the owner's household who owns a motor vehicle shall
be eligible to apply for a permit issued under this subsection.
e.
The permit shall be 5 1/2 inches by 8 1/2 inches in size
and shall bear an appropriate certification of authenticity and shall
be displayed prominently within the vehicle when it is parked so as
to be seen from the middle of the street.
f.
The permits acquired pursuant to this subsection shall expire on
June 30th of each calendar year and an administrative fee of $10 shall
be paid annually for the first permit issued to a private driveway
owner and $2 for each additional permit acquired pursuant to this
subsection.

a.
Parking by Permit Only in Designated Residential Areas. No vehicle
shall be parked on the streets or parts of streets designated in Schedule
XIX attached hereto and made a part of this chapter at any day or
time unless:
1.
The vehicle is owned or operated on a regular basis by a resident
of that street and;
2.
The vehicle has displayed on its left rear window, front dashboard
or from its rear view mirror, in such a manner as to be accessible
to visible examination by an officer, a current residential parking
permit or hanging tag.

3.
The vehicle falls under one of the exemptions to the parking ban.
b.
Exemptions. The following vehicles shall be exempt from this parking
permit subsection:
1.
Visitors. A vehicle displaying a current visitor parking permit or hanging tag may park on any of the controlled streets described on Schedule XIX provided that the operator of the vehicle is a bona fide guest of the residence within the permit parking area. The visitor's permit or hanging tag shall be displayed in accordance with § 7-3.10a2 of this section.

2.
Contractors, Service and Delivery Vehicles. Contractors, service
and delivery vehicles bearing the name and address of a commercial
business may park without a permit during the time they are rendering
service to a residence within the permit parking area.
3.
Emergency Vehicles. Emergency vehicles and public works, telephone
and other public utility vehicles may park within the permit parking
area during the time they are rendering service or repairs within
that area.
c.
Administration. Application for parking permits under this subsection
shall be made in writing on forms provided to the borough clerk, or
her designee. Permits shall be granted by the clerk under the following
terms and conditions:
1.
To persons who are residents on said street or portion thereof upon
which parking is restricted by this subsection, a permit shall be
issued for two vehicles owned or principally operated by such person.

2.
Two visitor permits shall be issued to each residential unit on any
street or portion thereof upon which parking is restricted by this
subsection for use only by visitors to that residential unit.
d.
Violations. It shall be unlawful and a violation of the provisions
of this subsection for any person to:
1.
Cause, allow, permit or suffer any vehicle registered in name or
operated by such person to be parked in any of the areas designated
on the attached Schedule XIX as established as a permit parking zone
as herein described unless said vehicle displays a proper and current
decal in accordance with this subsection.
2.
Willfully defraud, misuse or improperly obtain any decal so as the
decal is used for a vehicle or person not entitled to use that decal
as described under the provisions of this subsection.
e.
Penalty. Any person who shall violate or fail to comply with any
of the provisions of paragraph d,1 as set forth therein shall be deemed
guilty of an offense and shall be punished by a fine of $25 first
offense; $50 second offense; not less than $100 nor more than $1,000
for third and subsequent offenses.
Any person who shall violate or fail to comply with the provisions
of paragraph d,2 as set forth therein or who aids or abets any such
violation or failure to comply with that subsection shall be deemed
guilty of an offense and shall be punished by a fine of not less than
$250 nor more than $1,000 or by imprisonment not to exceed 30 days,
either or both of those penalties to be imposed at the discretion
of the court.

Pursuant to N.J.S.A. 39:4-139 no operator of a vehicle shall
stand or park the vehicle for a period of time longer than is necessary
to drop off or pick up students or other passengers which time shall
not consume more than three minutes.

It shall be unlawful to park any tractor-trailer cab, all trucks
having a net weight of more than four tons, and motor drawn other
than boat or watercraft trailers or recreation vehicles, on any street
within the Borough of Union Beach, between the hours of 12:00 midnight
and 6:00 a.m.
When a member of one of the building or service trades, such
as a carpenter, electrician, painter, plumber or T.V. repairman, etc.
is engaged in loading or unloading or parking of a service truck,
during performance by such person of his job on a particular property,
he shall be exempt from the terms of this subsection.

Vehicles over four tons gross weight will be allowed to travel on the county roadways and major municipal roadways within the municipality as described in Schedule V of Chapter 7A.

The streets or parts of streets described in Schedule VI of Chapter 7A are hereby designated as one-way streets in the direction indicated.

Pursuant to the provisions of R.S. 39:4-140, the streets or parts of streets described in Schedule VII of Chapter 7A are hereby designated as Through Streets. STOP signs shall be installed on the near right side of each street intersecting the Through Street except where YIELD signs having sides 36 inches in length are provided for in the designations.

No person shall make a right turn when facing a steady red signal (STOP) indication whenever an official sign is present prohibiting such turn on the red signal as described in Schedule XVI of Chapter 7A.

The streets or parts of streets described in Schedule XVII of Chapter 7A shall have the speed limits designated in such schedule.
Regulatory and warning signs shall be erected and maintained
to effect the above designated speed limits as authorized by the department
of transportation.

Unless another penalty is expressly provided by New Jersey Statute,
every person convicted of a violation of a provision of this ordinance
or any supplement thereto shall be liable to a penalty of not more
than $200 or imprisonment in the county jail or another place of imprisonment
or confinement for a term not exceeding 90 days or a period of community
service not exceeding 90 days, or both a fine and imprisonment and/or
community service.
