Pursuant to N.J.S.A. 40A:9-133 et seq., there shall be a Municipal Clerk appointed by the Mayor with the advice and consent of the Borough Council. The term of office of the Clerk shall be three years which shall run from the day of appointment in the year in which the Clerk was appointed. (N.J.S.A. 40A:9-133)
No person shall be appointed or reappointed as Borough Clerk unless that person shall have a Registered Municipal Clerk Certificate issued pursuant to N.J.S.A. 40A:9-133 et seq. (N.J.S.A. 40A:9-133)
The compensation for the Municipal Clerk shall be established in the Salary Ordinance. (N.J.S.A. 40A:9-165)
The Municipal Clerk shall:
a. 
Act as secretary of the municipal corporation and custodian of the municipal seal and of all minutes, books, deeds, bonds, contracts, and archival records of the municipal corporation. The Governing Body may, however, provide by ordinance that any other specific officer shall have custody of any specific other class of record;
b. 
Act as secretary to the Governing Body, prepare meeting agendas prior to meetings of the Governing Body, be present at all meetings of the Governing Body, keep a journal of the proceedings of every meeting, retain the original copies of all ordinances and resolutions, and record the minutes of every meeting;
c. 
Serve as the chief administrative officer in all elections held in the Borough, subject to the requirements of Title 19 of the New Jersey Statutes Annotated;
d. 
Serve as the chief registrar of voters in the Borough, subject to the requirements of Title 19 of the New Jersey Statutes Annotated;
e. 
Serve as the administrative officer responsible for the acceptance of applications for licenses and permits and the issuance of licenses and permits, except where statute or ordinance has delegated that responsibility to some other Borough officer;
f. 
Serve as coordinator and records manager responsible for implementing local archives and records retention programs as mandated pursuant to Title 47 of the New Jersey Statutes Annotated;
g. 
Perform such other duties as are now or hereafter imposed by statute, by ordinance or by regulation. (N.J.S.A. 40A:9-133e)

a. 
Creation of Office. A Deputy Municipal Clerk may be appointed by the Mayor with the advice and consent of the Borough Council pursuant to N.J.S.A. 40A:9-135.
b. 
Appointment; Term of Office. Appointment to the office of Deputy Municipal Clerk may be made by the Mayor and confirmed by a majority of the Council, and the appointment shall be made from those who are employees in the Municipal Office of the Borough. The appointee shall hold office until January 1 following the year of appointment.
c. 
Powers and Duties. The Deputy Municipal Clerk shall have all the powers and perform all the duties of the Municipal Clerk during such times and for such specific periods as the Municipal Clerk shall be absent.
d. 
Compensation. The compensation of the Deputy Clerk shall be as set forth in the Salary Ordinance.

Pursuant to N.J.S.A. 40A:9-136 et seq., there is hereby created the Office of Borough Administrator to serve at the pleasure of the Governing Body and to perform those duties as set forth in the statutes of the State of New Jersey and this section.

The Borough Administrator may be appointed by the Mayor with the advice and consent of the Borough Council. The appointment shall be made within 120 days after this section becomes effective unless this time is extended by resolution of the Borough Council. If the Mayor fails to make such appointment within said 120 days or agreed upon time frame, or if the Borough Council fails to consent to the appointment made by the Mayor within 30 days after receiving the nomination, then after the expiration of 30 days, the Borough Council shall appoint the Borough Administrator. Any vacancy which may occur in the position, whether the same occurs by death, resignation, or otherwise, shall be filled in the same manner. These time constraints shall be computed from the day the vacancy occurs. A vacancy shall be deemed to commence upon cessation of duties of the duly appointed Borough Administrator.

a. 
The appointment of a Borough Administrator shall be solely based on the administrative qualifications of the appointee, with special regard as to education, training and actual experience in governmental affairs.
b. 
No elected member of the Governing Body shall be eligible for appointment as Borough Administrator during his term of office nor within one year after the expiration of said term.
c. 
The person appointed to the Office of Borough Administrator need not be a resident of the Borough at the time of their appointment and may reside outside of the municipality.

The Borough Administrator shall serve at the pleasure of the Governing Body. During such term, the Administrator shall be subject to periodic review and evaluation of performance.

The Borough Administrator may be removed by a 2/3 vote of the Governing Body. The Resolution of Removal shall become effective three months after its adoption by the Governing Body. However, the Governing Body may provide that the Resolution have immediate effect, in which case, the Administrator shall be paid forthwith any unpaid balance of his salary and his salary for the next three calendar months following adoption of the Resolution.

During any approved absence or disability of the Borough Administrator, the Mayor may appoint, subject to confirmation by the Borough Council, another individual or any employee or officer of the Borough to temporarily perform the duties and responsibilities of the Borough Administrator. After three months of such absence or disability, the position may be deemed vacant after recommendation by the Mayor and confirmed by a resolution of the Borough Council. Compensation, if any, for duties performed for an appointment under this section will be determined by the recommendation of the Mayor and approved by the Borough Council. Subsection 2-10.2 shall not apply to any appointment made pursuant to this subsection.
The Borough Council may, by resolution, authorize the Borough Administrator to appoint any employee or officer of the Borough to temporarily perform the duties and responsibilities of the Borough Administrator during any planned absence from the municipality of more than two and no more than seven days. Any such appointment by the Borough Administrator shall be reported to the Governing Body in writing.

The Borough Administrator shall receive such compensation as shall be prescribed by the annual salary ordinance of the Borough Council. The Borough Administrator shall be reimbursed for all reasonable expenses incurred in the performance of the office. The Governing Body may choose to stipulate the terms and conditions of the Administrator in a formal Employment Agreement provided that any such Agreement is adopted by resolution.

The Administrator shall perform the duties hereinafter enumerated and such other duties as may be assigned by the Governing Body. The Administrator's entire time and effort shall be devoted to the performance of the duties and functions of the position of Administrator and the Administrator shall not engage in any other occupation or employment while employed by the Borough, except as approved by the Borough Council.

The Borough Administrator shall not engage in any political activity, nor shall make any financial or other contributions to any local political campaign, nor lobby the elected officials on behalf of a political party or campaign.

The Borough Administrator shall act as the Chief Administrative Officer of the Borough and shall be responsible to the Borough Council for the executive responsibilities of the municipality subject to N.J.S.A. 40A:9-136. Duties shall include the development of rules and regulations for administrative procedures governing purchasing practices, operation of all departments in conjunction with the statutorily or contractually authorized/designated department head, personnel management and general coordination of departments, offices, boards and agencies of the municipality, all for the purpose of increasing the effectiveness and efficiency of the municipal government and promoting its economic operation. All rules and regulations promulgated and implemented by the Borough Administrator shall be filed with the Governing Body and shall become Borough organizational policy unless specifically amended or rescinded by the Borough Council.
The Borough Administrator shall perform the duties hereinafter enumerated and such other duties as may be assigned by the Governing Body.
The Borough Administrator shall report annually to the Governing Body on the progress of each department; shall initiate goals and objectives to be reviewed on an annual basis with special emphasis on critical problems and deterrents to the achievement thereof.
The Borough Administrator shall be responsible for the organization and management of the work, personnel and programs in all departments; for the development and operation of a personnel program for all employees; and he (she) shall be accountable for the planning, organization, delegation, staffing, operation control, evaluation and correction in all departments to achieve maximum results.
The Borough Administrator is given broad authority with the approval of the Governing Body to combine or eliminate functions, to redesign and reorganize work effort and to assign personnel to achieve maximum productivity.
The Borough Administrator shall make assessments of municipal programs and operations reporting to the Governing Body on his (her) findings, setting forth a remediation action plan if necessary or required changes in Borough ordinances and procedures.
a. 
Personnel. The Borough Administrator shall:
1. 
Supervise all department heads and supervisors of the various municipal departments, answerable directly to the Borough Council Committee charged with oversight of each department and indirectly to the Governing Body as a whole. Each and every municipal department head, director and supervisor shall report to the Borough Administrator who shall supervise all personnel of the Borough through the respective department heads unless otherwise provided for by law or this section.
2. 
Advise the Mayor and Council on all matters of personnel administration, and organization and assign personnel to the performance of all duties in all departments.
3. 
Study, recommend, implement and enforce personnel organization and policy of the Borough and implement personnel leave policies as established by the Mayor and Council for all departments, except as otherwise provided by law for Police and Fire Departments.
4. 
Maintain comprehensive personnel files and evaluation systems of job performance and duties.
5. 
Administer and negotiate on behalf of the Borough all labor contracts.
6. 
Serve as the personnel officer of the Borough and, with the concurrence of the Mayor, have the authority to hire, evaluate, transfer, promote, discipline and/or discharge all employees to the extent not prohibited by law or provided for elsewhere in the ordinances of the Borough. In those instances where the final authority rests with another agency, the Borough Administrator shall assist that agency by recommending personnel actions which are consistent with those applied to other Borough employees.
7. 
Investigate the affairs of any employee, officer, department, agency or authority of the Borough when necessary or directed by the Mayor or Council and submit a report relating thereto.
b. 
Budget. The Borough Administrator shall:
1. 
Direct the preparation of the temporary budget for presentation in accordance with State statutes.
2. 
Direct the preparation of the annual capital and operating budget to be presented to the Borough Council for adoption. In preparing these budgets, the Administrator or an officer designated by the Administrator shall obtain from the head of each department, Council, board, commission, agency, officer or authority estimates of anticipated expenditures and supporting data as requested.
3. 
Prepare and compile budget studies, analysis and schedules; assist in the conduct of public, departmental, board, Council, and commission budget hearings; and in conjunction with the Chief Financial Officer, shall assist the Governing Body in such manner as they shall require in the review of and adoption of the annual budget.
4. 
Prepare and submit to the Governing Body an explanatory budget message, including a comparison of prior years revenues, appropriations and expenditures as well as an analysis of the proposed revenues and expenditures.
c. 
Fiscal Affairs. The Borough Administrator shall:
1. 
Upon the adoption of the budget, insure that current accounts of the expenditures shall be kept on a monthly basis based upon the supplemental detail of the adopted budget.
2. 
Administer the budget after its adoption by the Governing Body, shall maintain a continuing review and analysis of the budget operation, work progress and costs of municipal services; and shall assess the attainment of the Borough's budget and service goals, reporting the same regularly to the Governing Body.
3. 
See that all money owed the Borough is promptly paid, and that proper proceedings are taken for the security and collection of all Borough claims.
4. 
Study, recommend, implement, and enforce the financial procedures and policy of the Borough and its departments, after consultation with department heads and approval of the Governing Body.
5. 
Supervise the disbursement of all Borough funds and review all purchases, vouchers and bills before submitting same to the Governing Body for final approval.
6. 
Be responsible to assure that the appropriate persons see to the cash needs of the Borough and for the conduct of a sound investment and debt management program subject to governing board policy and report such actions and results to the Governing Body semi-annually or more frequently when directed.
d. 
Collective Bargaining and Employee Contracts.
The Borough Administrator shall be responsible for the negotiation of collective bargaining contracts with agencies representing Borough employees, subject to the approval of the Governing Body, and for the administration and enforcement of such contracts and the Personnel Policies and Procedures of the Borough.
e. 
Contracts. The Borough Administrator shall:
1. 
See that the provisions of all franchises, leases, permits and privileges granted by the Borough are complied with and provide periodic reports of said compliance upon request.
2. 
Negotiate contracts for the Borough upon request of the Governing Body and subject to the approval of the Governing Body.
3. 
Attend to the letting of contracts, in due form of law and supervise their performance and faithful execution except insofar as such duties are expressly imposed upon some other Borough officer or official by statute.
4. 
See that all terms and conditions imposed in favor of the Borough or its inhabitants in any statute, public utility, franchise or other contract are faithfully kept and performed, and upon knowledge of any violations, call the same to the attention of the Governing Body.
5. 
Advise the Governing Body if professional or other outside resources should be utilized.
f. 
Grants.
The Borough Administrator shall be responsible for researching, initiating action for, applying for and supervising the implementation of funding grants from various sources for the improvement and development of Borough capital projects and needs as well as for services to the Borough and its residents.
g. 
Administration. The Borough Administrator shall:
1. 
Study the governmental and administrative operations and needs of the Borough, and prepare and recommend to the Governing Body necessary and desirable plans and programs to meet present and foreseeable needs.
2. 
Develop, prescribe and enforce rules and regulations for the efficient management of the Borough for the avoidance of any duplication or overlapping effort among the departments or among the units within a department, and for the improvement of methods and procedures of administration.
3. 
Integrate and coordinate the functions of all departments, Boards, Agencies, Offices and Officials, and also maintain liaison with the Board of Education. The Administrator shall be responsible for continually improving communications among the various Borough personnel, departments, agencies, boards and the Governing Body.
4. 
Recommend the employment of experts and consultants to perform work and render advice in connection with Borough projects or services.
5. 
Make recommendations which may increase the efficiency of the operation of the Borough.
6. 
Continually review and supervise the Borough's insurance program.
7. 
Be responsible for the overall supervision and maintenance of real property owned by the Borough, except as modified through delegation by the Governing Body or ordinance to autonomous boards or commissions.
8. 
Assign office space, furniture, telephone, computer and similar facilities, and other Borough resources among and within departments.
h. 
Communication and Complaints. The Borough Administrator shall:
1. 
Study, recommend, implement and enforce procedures and policy of the Borough and its departments for receipt, dissemination and collation of responses to communications and requests for information, after consultation with department heads and receive, distribute and follow up requests for information and complaints from citizens and keep the Governing Body informed on such matters.
2. 
The Administrator or an officer designated by the Administrator shall investigate and dispose of such complaints and the Administrator shall keep written record of such complaints and when and what action was taken in response thereto and provide the Governing Body a copy thereof when requested to do so.
i. 
Public Improvements.
The Borough Administrator shall make recommendations concerning the nature and location of public improvements and coordinate and expedite the public improvements authorized by the Governing Body.
j. 
Other Duties. The Borough Administrator shall:
1. 
Ensure that there is an up-to-date and coordinated filing system and records retention system for all Borough departments, offices, boards and agencies.
2. 
Represent the Borough and assert its proper interests in relation to Federal, State, County and other political subdivisions, and with respect to Borough contracts, franchises and interests.
3. 
Monitor and evaluate State and Federal legislation as to its impact on the Borough with recommendations for actions by the Governing Body. The Administrator must be prepared to testify on behalf of the Borough on issues affecting the community on behalf of the Governing Body.
4. 
Study the Public Utility rates and policies and evaluate same and recommend to the Governing Body an appropriate course of action.
5. 
Attend all regular and work session meetings of the Governing Body, with the right to speak but not vote on agenda items, and attend other meetings as directed by the Governing Body. The Administrator shall receive notice of and may attend and participate in all regular and special meetings of the Governing Body and all advisory Councils, boards, commissions, and other agencies of the Borough. The Administrator shall not be barred or removed from any regular or special meeting of the Governing Body without his permission or when given proper written notice.
6. 
Keep the Governing Body informed as to the conduct of the Borough affairs; submit periodic reports, either in writing or orally, on the condition of the Borough finances; and shall submit other reports, either in writing or orally, as deemed advisable or as the Governing Body shall request; and shall make recommendations to the Governing Body necessary and advisable for the welfare and safety of the Borough.
7. 
Submit to the Governing Body as soon as possible after the close of the fiscal year, a complete written report of the administrative activities of the Borough for the preceding year.
8. 
Implement all policies formulated by the Governing Body unless specifically directed otherwise by a formal action of the Governing Body.
9. 
Advise the Governing Body on all background matters as an aid to the creation of policy and recommend to the Governing Body adoption such measures as may be deemed necessary or expedient.
10. 
Follow up acts of the Governing Body by correspondence, review of minutes and personal conferences.
k. 
Purchasing. The Borough Administrator shall:
1. 
Serve as the purchasing officer of the Borough and shall purchase, or supervise the purchase of or delegate the purchase of, in accordance with the provisions of the governing statutes and sound purchasing practices, all materials, supplies and equipment of the various agencies, boards, departments and other offices of the Borough. The Administrator shall keep or cause to be kept an account of all purchases and shall from time to time or when directed by the Governing Body, make a full report thereof.
2. 
Establish rules, regulations, standards and specifications to control all purchases by the Borough and recommend to the Governing Body such standards as to quality, size and variety of articles, equipment and supplies used by the offices and departments of the Borough, to make possible uniform purchasing practices; and act as purchasing agent in the purchase of such materials, equipment and supplies, and to issue or supervise the issuance of the necessary purchase orders for such materials, equipment and supplies for all departments without exception; ensure that all purchases are at the most favorable price to the Borough and see to it that the materials, equipment, services or supplies delivered are correct in number or amount and comply with the standards and specifications prescribed by the Governing Body as agreed to at the time of purchase.
3. 
Cause to be advertised proposals for the furnishings of work equipment and materials and receive bids therefore at the direction of the Governing Body.
4. 
Review, validate and recommend all bills and vouchers for payment prior to final approval by the Governing Body, and shall establish procedures associated with the voucher process.
5. 
Have no interest, directly or indirectly, in any contract job for work or materials, or the profits thereof, to be furnished to or performed for the Borough.
6. 
Require the various departments, boards, commissions, agencies and programs to furnish annually a complete inventory of all fixed assets; and recommend the sale of any obsolete or surplus equipment, materials and supplies, and transfer to or between departments, offices and agencies and from or to central stores such supplies, material and equipment as need appears and arrange for the sale of surplus or obsolete items thereof.

Nothing in this section shall derogate from or authorize the Borough Administrator to exercise powers of the elected officials of the municipality.

The Borough Administrator shall furnish a surety bond to be approved by the Governing Body, said bond to be conditioned upon the faithful performance of duties. The premium of said bond shall be paid by the Borough.

This section shall be known and may be cited as "the Borough Administrator Ordinance."

Pursuant to N.J.S.A. 40A:9-140.1 et seq., there is hereby created the position of Chief Financial Officer of the Borough.
The Chief Financial Officer shall be required to have a Municipal Finance Officer certification issued pursuant to the provisions of N.J.S.A. 40A:9-140.1 et seq. (N.J.S.A. 40A:9-140.13)
The compensation for this officer shall be established in the Salary Ordinance. (N.J.S.A. 40A:9-140.10)
Pursuant to N.J.S.A. 40A:9-140.10, the term of office shall be four years commencing January 1 of the year of appointment. (N.J.S.A. 40A:9-140.10)

The Chief Financial Officer shall be responsible for carrying out the duties set forth in N.J.S.A. 52:27BB-26 et seq.
The Chief Financial Officer shall:
a. 
Receive funds entrusted, received or under the control of any department and deposit all funds received by him in depositories authorized by the Governing Body by resolution.
b. 
Have custody of all investments and invested funds of the Borough or in possession of the Borough in a fiduciary capacity, except as otherwise provided by law, and keep such funds and all moneys of the Borough not required for current operations safely invested or deposited in interest bearing accounts.
c. 
Have the safekeeping of all bonds and notes of the Borough and the receipt and delivery of the Borough bonds and notes for transfer, registration or exchange.
d. 
Keep a full account of all case receipts and disbursements of the Borough and at least once each month, or more often if the Governing Body requires, furnish the Governing Body with a statement of all moneys received and expended by him/her.
e. 
Be responsible to carry out all duties and functions provided for in N.J.S.A. 40A:9-140.1 et seq. and shall perform such duties as the Mayor and Council may direct.
In accordance with N.J.S.A. 40A:9-139 there is hereby created by the Borough of Sea Girt the position of Borough Attorney. (N.J.S.A. 40A:9-139)

The Borough Attorney shall be a duly licensed attorney-at-law of the State of New Jersey.

The Borough Attorney shall be appointed by the Mayor with the confirmation of the Borough Council, and shall hold such position for a term of one year from January 1 of the year in which the appointment is made.

The Borough Attorney shall serve as legal advisor to the Governing Body and to the Borough officers and employees on matters pertaining to their duties, shall represent the Borough in litigation except where the Borough Council directs otherwise, shall draft all contracts, ordinances or other documents needed by the Borough and shall render such other legal services as may be required by the Borough Council.
b. 
It shall be the duty of the Attorney to see to the full enforcement of all judgments or decrees rendered or entered in favor of the Borough and of all similar interlocutory orders.
c. 
It shall be the duty of the Attorney to see to the completion of all special assessment proceedings and condemnation proceedings.

All papers, documents, memorandum, and other materials relating to prosecution or to the duties of the Borough Attorney shall be and shall remain the property of the Borough.
The compensation for the Borough Attorney shall be established in the Salary Ordinance. (N.J.S.A. 40A:9-165)
Pursuant to N.J.S.A. 40A:9-140, the Borough Engineer shall be appointed by the Mayor with the advice and consent of the Council for a term of three years. The Borough Engineer shall, prior to his/her appointment, hold a degree in civil engineering from a recognized school or college of engineering, be licensed in the State of New Jersey, and be qualified by further training and experience of at least five years in responsible engineering work. The Borough Engineer shall:
a. 
Have general supervision over all matters relating to the construction, management, maintenance and operation of the physical properties of the Borough, subject to the determination of the Governing Body to utilize a different engineer for specific projects.
b. 
Direct and supervise the preparation of plans and specifications.
c. 
Provide for the Borough's traffic engineering needs.
d. 
Provided all engineering and mechanical services required by any department, office or agency of the Borough, except the communications systems of the Police Department and the Fire Department.
e. 
Supervise the construction, reconstruction, maintenance and repair of all public streets within the limits of the Borough. The Borough Engineer shall also supervise street openings, the construction, alteration and repair of sidewalks, curbs and gutters, and encroachments by objects and structures above and below public streets and sidewalks, to prevent interference with the public use thereof and to maintain reasonable standards of maintenance and repair.
f. 
Provide for the construction, reconstruction, maintenance and repair of sanitary and storm sewerage systems within the limits of the Borough.
The Borough Engineer shall receive the compensation as established in the Salary Ordinance. (N.J.S.A. 40A:9-140)
Pursuant to N.J.S.A. 40A:9-141 et seq., the Mayor and Borough Council shall provide for the appointment of a Tax Collector. (N.J.S.A. 40A:9-141 et seq.)
No person shall be appointed or reappointed as Tax Collector unless he shall hold a Tax Collector's Certificate issued pursuant to N.J.S.A. 40:9-141, N.J.S.A. 40A:9-145.2 and N.J.S.A. 40A:9-145.3a. Any Tax Collector appointed pursuant to this section may obtain tenure pursuant to the provisions of N.J.S.A. 40A:9-144 or 40A:9-145. Any person who shall be reappointed Tax Collector subsequent to having received a Tax Collector's Certificate pursuant to N.J.S.A. 40:A:9-145.8 and having served as Tax Collector or who has performed the duties of Tax Collector for not less than four consecutive years immediately prior to such reappointment shall have acquired tenure and shall hold his or her office during good behavior and efficiency and shall be removed only for good cause shown and after a proper hearing before the Director of the Division of Taxation or his designee in accordance with the provisions of N.J.S.A. 40A:9-145.8. (N.J.S.A. 40A:9-145.7; N.J.S.A. 40A:9-145.8)
The Tax Collector shall hold his office for a term of four years from January 1 next following his appointment. Vacancies other than due to the expiration of term shall be filled by appointment for the unexpired term. (N.J.S.A. 40A:9-142)
The Mayor and Borough Council shall determine the amount of compensation for the Tax Collector in the Salary Ordinance. (N.J.S.A. 40A:9-165)

The Mayor, with the approval of Council, shall appoint a Tax Assessor who shall perform the duties, possess the powers and have the responsibilities provided by the applicable statutes of the State of New Jersey and the ordinances of this Borough.

The Tax Assessor shall hold the Tax Assessor's Certificate provided for in N.J.S.A. 54:1-35.25 et seq. and shall have the duty of assessing property for the purpose of general taxation. Nothing in this section shall affect adversely the salary or tenure rights acquired pursuant to N.J.S.A. 54:1-35.31 or any other law. In accordance with the provisions of N.J.S.A. 54:3-16, the Assessor, when making assessments, shall be governed by directions by the County Tax Administrator. These directions shall be pursuant to rules adopted by the County Tax Board.

The Mayor and Borough Council shall determine the amount of compensation for the Tax Assessor in the Salary Ordinance.
The Tax Assessor shall hold office for a term of four years from the first day of July next following appointment. Vacancies other than due to expiration of term shall be filled by appointment for the unexpired term. (N.J.S.A. 40A:9-148)

There is hereby created the position of Purchasing Agent for the Borough of Sea Girt.

The Purchasing Agent shall be appointed by the Borough Council.

The Purchasing Agent is required to possess a valid Qualified Purchasing Agent certificate as issued by the New Jersey Division of Local Government Services, Department of Community Affairs.

The Purchasing Agent shall have, on behalf of the Borough Council of the Borough of Sea Girt, the authority, responsibility and accountability for the purchasing activity pursuant to the Local Public Contracts Law, (N.J.S.A. 40A:11-1, et seq.); to prepare public advertising for and to receive bids and requests for proposals for the provision or performance of goods, services and construction contracts; to award contracts pursuant to New Jersey law in accordance with the regulations, forms and procedures promulgated by state regulatory agencies and the Purchasing Manual of the Borough of Sea Girt and construct any activities that may be necessary or appropriate to the purchasing function of the Borough of Sea Girt.
b. 
Pursuant to Local Finance Notice 2010-13 and N.J.A.C. 5:34-5.2, and as amended from time to time, the Purchasing Agent may issue contracts not subject to pay-to-play up to the local threshold amount of $36,000.
