Any person or persons who, or corporation which, shall fail
to comply with or who violates or offends against any of the provisions
of the foregoing ordinance or any section thereof or who commits any
act or thing prohibited or refuses or fails to do any thing or act
required to be done or who shall refuse or fail to comply with an
order of the Mayor and Borough Council made as a direct result of
the enforcement of provisions of this ordinance shall, upon conviction
thereof in the Municipal Court of the Borough of Wenonah, pay a fine
of not less than $50 nor more than $200 for each offense as shall
be imposed by the Judge of said Municipal Court, at his discretion,
or if the party so convicted shall be a natural person, he may be
imprisoned for such terms not exceeding 90 days as said Judge, in
his discretion, shall determine; provided, however, that if the party
so convicted shall be a natural person, such Judge shall have the
power, in his discretion, to impose sentence of both fine and imprisonment
not exceeding the maximum limits hereinbefore fixed. Whenever such
person shall have been officially notified by the Chief or line officer
designated hereunder or by service of summons in a prosecution or
in any other official manner that he is in violation of this ordinance,
each day's continuance of such violation after such notification shall
constitute a separate offense, punishable by a like fine or penalty.
All line officers of the Fire Company are hereby given the necessary
special police powers for the purpose of enforcing the provisions
of this ordinance.
It is hereby made the special duty of the Chief of Police and/or
other police officers who may be on duty and available for fire duty,
to respond to all fire alarms and assist the Fire Company in the protection
of life and property, in regulating traffic, maintaining order and
in enforcing observance of all sections of this ordinance. The Chief
of the Fire Company may request the assistance of the police reserves
in emergencies.
