The following terms, as used in this chapter, are defined below:
SCOOTER
A low board, motorized or nonmotorized, fitted with one or more wheels at each end and a steering handle attached to the axle of the front wheel used to glide or propel the user across the ground.
SKATEBOARD
A piece of wood, fiberglass or other rigid material, motorized or nonmotorized, mounted on wheels used to glide or propel the user across the ground.
Every person operating any skateboard or scooter upon a roadway shall be granted all of the rights and shall be subject to all of the duties applicable to the driver of a vehicle by Chapter 4 of Title 39 except as those provisions thereof which by their nature can have no application.
No person under the age of 14 may operate or occupy any skateboards or scooters without wearing a properly fitted and fastened helmet, as defined in N.J.S.A. 39:4-10.1, which meets the standards of the American National Standards Institute (ANSI Z90.4 bicycle helmet standard), or the Snell Memorial Foundation's 1990 Standard for Protective Headgear for use in Bicycling, the American Society for Testing and Materials standard or other such standard, as appropriate.
Any person operating any skateboard or scooter upon a roadway shall ride as near to the right side of the roadway as practicable, in single file, exercising due care when passing a standing vehicle or one proceeding in the same direction; provided, however, that any person may move to the left under any of the following situations:
A. 
To avoid pedestrian traffic, vehicles, debris, drains or other hazardous conditions that make it impracticable or unsafe to ride at the right side of the roadway;
B. 
To pass a slower moving skateboard or scooter;
C. 
To travel no more than two abreast when traffic is not impeded.
The operation of any skateboard or scooter by any person under the age of 14 is prohibited upon the following roadways:
A. 
State roadways;
B. 
County roadways.
A. 
Any person, or in case of a violation by a minor, the parent or legal guardian of the violator, who violates any provisions of this chapter shall be fined a minimum of $25 and a maximum of $250 per offense.
B. 
The Judge of the Municipal Court may waive any fine for which a person who violates the provisions of this chapter if such person, or in the case of a minor, a parent or legal guardian of such person, provides the Court with suitable proof that an approved helmet or appropriate personal protection equipment has been purchased since the violation occurred.
