Borough of Wenonah, NJ Vehicles and Traffic

No operator of a vehicle shall stand or park a vehicle within resident permit parking areas upon any of the following described streets, or parts thereof, during the days and times hereinafter enumerated, except such vehicles that have been issued and display a valid resident parking permit:

Only vehicles with and displaying a current resident parking permit may park in the above-described areas, with the exception of vehicles being used to move household effects and displaying a current temporary permit. The resident parking permit area shall be indicated by signage expressing the language "Parking By Permit" and identifying the above recited days and hours of such restriction.

Resident permits: Qualifications. A resident parking permit, of a design specified by the Wenonah Borough Clerk, will be issued for motor vehicles with a gross weight of not more than 2.5 tons owned or leased by a resident of Wenonah, which resident resides within a residential household adjoining resident permit parking areas, based upon the following:

(a)

Proof of residency by the owner or lessee of the vehicle must be presented when applying for a permit. Acceptable proofs of residency include a valid lease, title or tax bill for a legal, residential Wenonah property adjoining a resident permit parking area, a valid New Jersey driver's license reflecting such resident's address as the same as the other proofs submitted.

(b)

Resident parking permits shall be placed on the lower, left-hand corner of the front windshield of the driver's side, or the lower, left-hand corner of the rear windshield or the lower, left-hand portion of either driver's-side window of the registered vehicle.

(c)

No more than five permits for vehicles shall be issued to any single residence.

(d)

Such other evidence as the Wenonah Borough Clerk shall require verifying the qualifications aforesaid.

(e)

With the exception of vehicles being utilized by individuals providing repair and or maintenance service to adjacent property owners for the duration of the repair/maintenance activity, as a note, this would be reasonable for a daily or brief situation, it would be recommended that any longer-term project provider seek temporary permits.

Temporary permits, with a duration of not more than 45 days from the date of issuance, may be issued in special circumstances consistent with the purposes of this section. Examples of such special circumstances include persons awaiting issuance of a driver's license, for vehicles in short-term use such as rental cars or moving vans or other similar circumstances within the discretion of the Chief of Mantua Police Department.

All ordinances of the Borough of Wenonah inconsistent with the provisions of this section be and are hereby repealed to the extent of such inconsistency.

All existing ordinances not inconsistent with the provisions of this section be and are hereby saved from repeal. Should any section, clause, sentence, phrase or provision of this section be declared unconstitutional or unlawful by a Court of competent jurisdiction, all other parts or provisions of this section shall be deemed lawful and enforceable.

(7)

This section shall take effect immediately upon passage, publication and as otherwise provided by law.

Violations and penalties. Any vehicle parked on a street posted as Permit Parking Only without a valid resident permit or temporary permit shall be subject to a fine of $35.

§ 67-3 No-parking zones.

Within a distance of 25 feet beginning at the crosswalk, parking is prohibited at intersections wherein conditions are such that the view of other motorists would otherwise be obstructed. The Police Committee will be responsible for designating these intersections. Curbs will be painted yellow, and traffic signs will be erected to indicate such no-parking zones.

Parking is specifically prohibited within a distance of 25 feet from the crosswalk at the intersection of Mantua Avenue and North West Avenue. Beginning at a distance of 25 feet from the above-cited intersection, both perpendicular and angle parking along the westerly side of North West Avenue is also strictly prohibited.

§ 67-3.1 Handicapped parking zones.

No person shall park any vehicle at any time in any parking space which is clearly marked and/or signed as a reserved space for handicapped persons unless the driver or a passenger in said vehicle is actually handicapped and such vehicle bears the certificate, insignia or license plate issued by the Director of the Division of Motor Vehicles for handicapped persons.

The following locations shall contain reserved spaces for handicapped parking and shall be appropriately marked and/or signed:

The west side of North East Avenue adjacent to the Wenonah Community Center.

The east side of North Clinton Avenue adjacent to the Wenonah Public Library beginning at 48 feet north of the north curbline of Mantua Avenue to 73 feet north of the north curbline of Mantua Avenue and being eight feet wide from the curbline. Violating shall be subjected to fines in accordance with N.J.S.A. 39:4-197(3)(c).

The east side of South West Avenue adjacent to the Wenonah Municipal Building.

The west side of the parking lot adjacent to Wenonah Lake, two spaces (van accessible), 151 feet to 175 feet north of the north curbline of Maple Avenue.

The south side of Mantua Avenue beginning at a distance of 57 feet from the westerly curbline of the intersection with South Princeton Avenue and continuing 104 feet westerly shall contain three twenty-six foot parking spaces and one twenty-six foot drop-off space.

The north side of East Elm Street adjacent to the Wenonah Elementary School beginning at 104 feet west of the west curbline of Clinton Avenue extending to 172 feet west of the west curbline of North Clinton Avenue, utilizing the existing handicapped ramp adjacent to the 172-foot mark from west of North Clinton Avenue which shall be appropriately marked with blue paint. Violations shall be subjected to fines in accordance with N.J.S.A. 39:4-197(3)(c).

§ 67-3.1.a Handicapped resident parking.

Purpose. The purpose of this ordinance is to establish a restricted parking zone, by ordinance, in front of a residence occupied by a handicapped person, which person has been issued a windshield placard or wheelchair symbol license plate for a vehicle owned by the handicapped person, or by another occupant of the residence who is a member of the immediate family of the handicapped person. This chapter is amended in accordance with N.J.S.A. 39:4-197.6 conferring upon the Borough a right to establish resident handicapped on-street parking in order to preserve and safeguard the public health, safety and welfare.

Enactment. There is hereby established, in accordance with N.J.S.A. 39:4-197.6, permissible resident handicapped parking spaces within public streets of the Borough of Wenonah subject to the following criteria:

Any person requesting an on-street resident handicapped parking space shall be a resident of the Borough of Wenonah who shall make application to the Wenonah Police Department. The application shall be reviewed and approved or denied by the Chief of Police. A denial of an application may be appealed to the Borough Council if a request, from the resident aggrieved by the denial, is received within 20 days from the date of denial. Any denial of the Chief of Police shall be confirmed in writing with a copy provided to the applicant.

Any person requesting an on-street resident handicapped parking space, to qualify, shall have been issued a wheelchair symbol license plate or windshield placard issued by the New Jersey Motor Vehicle Commission which is properly displayed in either the handicapped resident's vehicle or a vehicle of an immediate family member who also resides at the residence of the handicapped person.

The subject property shall pass an on-site inspection by the Wenonah Police Department, which inspection shall determine whether handicapped parking will interfere with the normal flow of traffic or whether there is immediate, adjacent off-street parking available to the applicant. For the purposes of this criteria, available "off-street parking" shall mean adjacent public parking or private driveway parking.

The applicant shall comply with the provisions of N.J.S.A. 39:4-198(o) and 39:4-197.6 regulating handicapped parking in designated spaces.

Upon approval of an applicant's request for resident handicapped on-street parking, the Borough will enact an appropriate ordinance designating the name of the subject street, the side of that street where the resident resides and a description of the permitted, restricted parking area in front of the subject residence. Such designation shall be within an area on the street within the extended property line of the subject residence, but otherwise shall be subject to the discretion of the Police Department and the Chief of Police. Upon approval, the authorizing ordinance shall designate appropriate signage for the handicapped parking space and authorize issuance of a permit by the Police Department relative thereto.

Violations and penalties. Any person improperly parking in a properly designated resident handicapped restricted parking space shall be subject to the penalties provided by N.J.S.A. 39:4-203 and N.J.S.A. 39:4-207.7.

No operator of a vehicle shall stand or park a vehicle upon the following described streets or parts thereof unless theretofore issued and displaying a Handicapped Resident Parking permit, as follows:

§ 67-3.2 Speed Limits Established.

§ 67-3.3 Posting of Signs.

Regulatory and warning signs shall be erected and maintained to effect the above designated speed limits as authorized by the Department of Transportation.

§ 67-4 Towing away.

Any vehicle parked in violation of this chapter shall be deemed a nuisance and menace to the safe and proper regulation of traffic, and any police officer may provide for the removal of such vehicle. The owner shall bear the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.

§ 67-4.1 Severability.

The provisions of this ordinance are severable. If any provision of this ordinance or the application thereof to any person or circumstances is held to be invalid, such invalidity shall not affect other provisions or applications of this ordinance which can be given effect without the invalid provision or application.

§ 67-5 Repealer.

Any ordinance or part thereof which is inconsistent with the terms of this ordinance is hereby repealed to the extent of such inconsistency; and specifically Chapter 67, Articles I and II, of the Code of the Borough of Wenonah is hereby repealed and this ordinance shall be substituted therefor.[1]

§ 67-6 When effective.

This ordinance shall take effect on its publication after final passage as required by law.

§ 67-7 Truck exclusion.

Trucks rated over four tons' gross weight are hereby excluded from all streets within the Borough of Wenonah except for local pickup and delivery of material within the Borough of Wenonah. This section shall specifically include Maple Avenue from Woodbury-Glassboro Road to the boundary line between the Borough of Wenonah and the Township of Deptford.

§ 67-8 Violations and penalties.

Any person violating or failing to comply with any of the provisions of this chapter shall, upon conviction thereof, be punishable by a fine in an amount not less than $25 nor more than $75, upon a second violation; a fine in an amount not less than $75 nor more than $150; and upon a third or subsequent violation, a fine in an amount not less than $150 nor more than $250; and/or a period of community service not to exceed 10 days. In addition, a person convicted of a violation of section 67-7, Truck exclusion, shall reimburse the Borough of Wenonah for all damages caused by the use of such vehicle in violation of said section. Whenever such person shall have been officially notified or by service of a summons in prosecution, or in any other official manner, that said person is committing a violation, each day's continuance of such violation after such notification shall constitute a separate offense, punishable by a like fine or penalty.

§ 67-9 Loading zones.

Mantua Avenue.

There is hereby created on Mantua Avenue a loading and unloading zone designated as follows: Such zone shall be on the northerly side of West Mantua Avenue and shall commence at a point 66 feet from the present curbline of North West Avenue and extend one vehicle length on West Mantua Avenue.

Such loading and unloading zone shall be a no-parking zone, except for purposes of loading and unloading, from 9:00 a.m. to 5:00 p.m., Monday through Saturday, inclusive.

Any person who shall violate this ordinance may be fined a minimum of $25 and not more than $100 and/or be incarcerated for a period of up to 30 days.

§ 67-9.1 Passenger loading or unloading zone.

Purpose. The purpose of this ordinance is to establish an area prohibiting the parking of vehicles, during certain days and times, except as may be necessary for the loading or unloading of passengers or materials consistent with the provisions of N.J.S.A. 49:4-139.

Enactment. No operator of a vehicle shall stand or park a vehicle for a period of time longer than is necessary for the loading or unloading of passengers or materials upon any of the following described streets or parts thereof during the days and times hereinafter enumerated, as follows:

§ 67-9.2 Drop-off zone.

Purpose: The purpose of this section is to establish a "drop-off zone" on the westerly side of Northwest Avenue.

Enactment.

No operator of a vehicle shall stand or park a vehicle except for the limited time necessary to discharge or pick up a passenger upon the described part of Northwest Avenue during the days and times hereunder enumerated.
