A certain document, one copy of which is on file in the office of the Secretary of the Township of North Franklin, being marked and designated as the "BOCA National Fire Prevention Code, 1996, Tenth Edition," as published by the Building Officials and Code Administrators International, Inc., be and is hereby adopted as the Fire Prevention Code of the Township of North Franklin for the control of buildings and structures and premises as herein provided, and each and all of the regulations, provisions, penalties, conditions and terms of said BOCA National Fire Prevention Code are hereby referred to, adopted and made a part hereof as if fully set out in this article with the additions, insertions, deletions and changes, if any, prescribed in § 190-2 of this article.

The following sections are hereby revised as follows:
A. 
Section F-101.1, Title, shall be amended to read:
§ F-101.1. Title. These regulations shall be known as the "Fire Prevention Code of the Township of North Franklin," hereinafter referred to as "this code."
B. 
Table F-107.2.3, Permits, shall be amended to read:
§ F-107.2.3. Permits. Permits shall be required in accordance with Table F-107.2.3 as established, from time to time, by resolution of the Township of North Franklin.
C. 
Section F-112.3 of the 1996 Edition of the National Fire Prevention Code is hereby amended to read as follows:
§ F-112.3. Any violation of the provisions of this code shall result in a mandatory fine of not less than $500 nor more than $1,000.
The limits referred to in Section F-300.3.2 of the BOCA National Fire Prevention Code, 1996, in which the storage of explosive materials is prohibited, are hereby established to include the entire jurisdiction of the Township of North Franklin.

Building Inspection Underwriters, Inc., in accordance with the provision the Second Class Township Code,[1] is hereby appointed as the Fire Inspection Office under the provisions of the existing National Fire Prevention Code.

Building Inspection Underwriters, Inc.'s duties, obligations and compensation are as determined by the National Fire Prevention Code and as set forth in a written agreement between Building Inspection Underwriters, Inc. and the Township, which is attached hereto as Exhibit "A" and made a part hereof.
The Board of Supervisors hereby adopts a fire inspection annual permit fee, which is set forth in Exhibit "B" which is attached hereto and made a part hereof.[1]

If any sentence, clause, section, or part of this article is for any reason found to be unconstitutional, illegal or invalid, such unconstitutionality, illegality or invalidity shall not affect or impair any of the remaining provisions, sentences, clauses, section or parts of this article. It is hereby declared as the intent of the Supervisors of the Township of North Franklin that this article would have been adopted had such unconstitutional, illegal or invalid sentence, clause, section or part thereof not been included herein.
All ordinances or parts of ordinances which are inconsistent herewith are hereby repealed.
