Appeals to the Zoning Board of Adjustment may be taken by any interested party affected by any decision of an Administrative Officer of the City, based on or made in enforcement of the Zoning Ordinance or Official Map in accordance with the provisions of § 25-800.4a of this Ordinance and N.J.S.A. 40:55D-72.
Any interested party may appeal to the governing body any final decision of the Zoning Board of Adjustment approving an application for development, pursuant to the provisions of N.J.S.A. 40:55D-70(d) (a use variance), providing such appeal shall be made within ten (10) days of the date of publication of such final decision, pursuant to N.J.S.A. 40:55D-10(i). The provisions of N.J.S.A. 40:55D shall control all such appeals.
If a public utility, as defined by N.J.S.A. 48:2-13, is aggrieved by the action of a Board or municipal agency, such an appeal may be made to the New Jersey Board of Public Utility Commissioners in accordance with the provisions of N.J.S.A. 40:55D-19. An appeal by certain public utilities aggrieved by the action of a Board or municipal agency shall be governed by the provisions of N.J.S.A. 40:55D-19.
