Editor's Note: The power of the Municipality to adopt ordinances concerning traffic and parking is contained in N.J.S.A. 39:4-197. Various statutory provisions throughout Title 39 control the manner in which municipalities may regulate parking and traffic. N.J.S.A.39:4-8 requires that all traffic and parking ordinances be approved by the Department of Motor Vehicles.

Whenever any words and phrases are used in this Chapter, the meanings respectively ascribed to them in Subtitle 1 of Title 39 of the New Jersey Statutes Annotated shall be deemed to apply to such words and phrases used herein.

Whenever certain hours are named in this Chapter, they shall mean either Eastern Standard Time or Eastern Daylight Saving Time, as may be in current use in the Borough.

The provisions of this Chapter imposing a time limit on parking shall not relieve any person of the duty to observe other more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey Statute or as hereinafter provided.

a. 
Upon the declaration of an emergency, there shall be no parking on streets or sections of streets where temporary EMERGENCY NO PARKING signs are displayed. The Chief of Police or, in his absence, the ranking police officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, fires, public celebrations, etc., dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
b. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.
c. 
The effectiveness of this subsection is contingent upon signs being erected as required by law.

Whenever snow has fallen and the accumulation is such that it covers the street, no vehicle shall be parked on the following main traveled or major roadways or portions thereof:
All Streets in the Borough.
The above parking prohibition shall remain in effect after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.

No person shall park a vehicle at any time on any of the streets or parts of streets described in Schedule I which can be found in Chapter 7A.

No person shall park a vehicle between the hours specified on any day on any of the streets or parts of streets described in Schedule II which can be found in Chapter 7A.

No person shall stop or stand a vehicle between the hours specified in Schedule III on any day upon any of the streets or parts of streets described in Schedule III which can be found in Chapter 7A.

No person shall park a vehicle for longer than the time limit specified, between the hours listed, on any day, except Sunday and public holidays, on any of the streets or parts of streets described in Schedule IV which can be found in Chapter 7A

a. 
Prohibition. It shall be unlawful to park on any public street between the hours of 9:00 p.m. and 6:00 a.m. Monday through Sunday including holidays the following: trucks, limousines, omnibuses, or trailers, attached or in combination thereof in excess of any one of the following:

Exceptions:
(a) 
When such motor vehicle is parked in a location at which parking is otherwise permitted and when it is actively engaged in the loading or delivery of passengers, goods, or materials from or to premises in front of which it is directly parked and then only for so long as it is actively being loaded or unloaded.
(b) 
When such motor vehicle is necessary to the rendering of services to the premises or the owners or occupants thereof, in front of which it is directly parked if parking in that location is otherwise permitted and then only for as long as is necessary to the rendering of such services.
b. 
Enforcement. This chapter shall be enforced by the Police Department.
c. 
Violations and Penalties. Any person, owner or operator who shall violate any provision of this subsection shall be subject to a fine of $35.

Trucks over four tons gross weight are hereby excluded, except for the pickup and delivery of materials, from the streets or parts of streets described in Schedule V which can be found in Chapter 7A.

Any person who violates any provisions of this section shall, upon conviction thereof, be punished by a fine not exceeding $33. A separate offense shall be deemed committed each day during or on which a new violation occurs or continues.

Pursuant to N.J.S.A. 40:716.1, the streets or parts of streets as described are hereby designated as routes for vehicles over 10 tons. Trucks over 10 tons gross weight are hereby excluded, except for the pickup and delivery of materials, from the streets or parts of streets described in Schedule XXI which can be found in Chapter 7A

Any person who violates any provisions of this section shall, upon conviction thereof, be punished by a fine not exceeding $100. A separate offense shall be deemed committed each day during or on which a new violation occurs or continues.

Pursuant to the provisions of N.J.S.A. 39:4-140, the streets or parts of streets described in Schedule VII, which can be found in Chapter 7A, are hereby designated as Through Streets. STOP signs shall be installed on the near right side of each street intersecting the Through Street except where YIELD signs having sides 36 inches in length are provided for in the designations.

The lane locations described in Schedule XVII, which can be found in Chapter 7A, are designated as Lane Use Reservations and traffic shall move only as indicated.

No person shall make a right turn during the specified hours at any of the locations described in Schedule XVIIA which can be found in Chapter 7A.

The streets or parts of streets described in Schedule XVIII, which can be found in Chapter 7A, shall have the speed limits designated in such schedule.
Regulatory and warning signs shall be erected and maintained to effect the above designated speed limits as authorized by the Department of Transportation.

No person shall park in the area situated on the premises described in Schedule XIX, which can be found in Chapter 7A, unless they have been issued special vehicle identification cards by the New Jersey Motor Vehicle Commission, when using a motor vehicle for which a special vehicle identification card has been issued by the Commission.

Any person who violates any provisions of this section shall, upon conviction thereof, be punished by a minimum fine of $253. A separate offense shall be deemed committed on each day during or on which a new violation occurs or continues.

Traffic control signals shall be installed and operated at the intersections designated in Schedule XX which can be found in Chapter 7A. The traffic signal installation shall be in accordance with the provision of an act concerning motor vehicles and traffic regulations, Subtitle 1 of Title 39 of the Revised Statutes; shall conform to the design and shall be maintained in operation, as authorized by the Department of Transportation.

Unless another penalty is expressly provided by New Jersey Statute, every person convicted of a violation of a provision of this ordinance or any supplement thereto shall be liable to a penalty of not more than $50 or imprisonment for a term not exceeding 15 days or both.
All former traffic ordinances of the Borough of Moonachie covered in this Traffic Chapter are hereby repealed except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this Chapter.

a. 
The following agencies and/or property owners have filed a written consent with the Borough of Moonachie that the provisions of Subtitle One, Title 39 of the Revised Statutes of New Jersey be made applicable to the semi-public roads, streets, driveways and parking lots, located in the Borough of Moonachie, County of Bergen and the following regulations and provisions shall be enforceable.
b. 
All vehicles must park only in designated areas and between the lines provided.
c. 
Handicapped Parking. All stalls shall be 12 feet wide as shown on the attached site plan and signed with R7-8 (Reserved Parking sign and penalty plate), in the designated parking areas for persons who have been issued the handicapped parking permits by the Division of Motor Vehicles.[1]

d. 
Reserved Parking. The parking lot has reserved parking for various types of vehicles which must be properly identified as per site plan.
e. 
Tow-Away. Any vehicle parked or standing as to obstruct or impede a normal flow of traffic, block entrances or exit ways, loading zones, oil filling areas, any grass area, pedestrian walkway, or present in any way a safety or traffic hazard may be removed by towing the vehicle at the owner's or operator's expense.
f. 
That all signs, posts, bolts, or other necessary materials be installed and paid for by the applicant property owner. Work shall be checked by the Police Department to insure that installations meet State and Federal specifications, and all signs shall conform to the current manual on Uniform Traffic Control Devices.
g. 
Speed Limits.
1. 
The speed limits for both directions of traffic in the parking lots shall be 15 m.p.h.
2. 
Regulatory and warning signs shall be erected and maintained to effect the above designated speed limits authorized by the Department of Transportation.
h. 
One-Way Entrance and Exit. The following described entrance and exit as shown on each respective site plan[2] are hereby designated as one-way in the direction indicated.

i. 
Unless another penalty is expressly provided by New Jersey Statute, every person convicted of a violation of this section or any supplement thereto, shall be liable to a penalty of: (a) first offense, $100; (b) second or subsequent offenses, not less than $100 nor greater than $1,000 plus community service up to 90 days or imprisonment for a term not exceeding 15 days or both.
j. 
Effect of Regulations. If any part of this regulation is for any reason held to be invalid, such decision shall not affect the validity of the remaining portion of the regulation.

The following parcels and/or individuals shall be subject to the specific provisions of this section.
a. 
Borough of Moonachie/Municipal Building and Police Headquarters;
b. 
Robert L. Craig School;
c. 
Moonachie Civic Center and Senior Citizens Center.
All parcels and fee owners who are subject to this section shall receive from the Borough Clerk within 20 days of adoption of this section, the site plan[1] prepared by the Department of Transportation, and shall, at their sole cost and expense, undertake any and all improvements to comply with the site requirements delineated thereon.

a. 
No vehicles shall be parked on any of the streets hereafter listed in the Borough of Moonachie between the hours of 9:00 a.m. and 11:00 a.m. Monday through Friday, except for legal holidays, unless:
1. 
The vehicle is owned or operated on a regular basis by a resident of the Borough of Moonachie and the vehicle has displayed, facing outward on the driver's side rear window, a current residential parking permit.
b. 
Permit Parking Only Streets Designated. The following streets are hereby designated as "Parking Permit Zone Only" streets in accordance with the terms and provisions of this Section.

a. 
The prohibitions set forth in paragraph a, subsection 7-16.1, shall not apply to the following classifications of vehicles:
1. 
Visitor's vehicles. A vehicle displaying a current visitor parking mirror tag permit may park provided that the operator of the vehicle is a bona fide transient guest of a resident of the Borough of Moonachie. The visitor's permit shall be displayed on the rearview mirror of the vehicle in such a manner as to be clearly visible by an officer enforcing parking regulations.
2. 
Contractor, service and delivery vehicles. Contractor, service and delivery vehicles bearing the name and address of a commercial business may park without permit during the times they are rendering residential service within the Borough.
3. 
Emergency and utility vehicles. Emergency vehicles, gas, electric, telecommunication and any other similar vehicles may park within the Borough during the times they are rendering service or repairs within the Borough.
4. 
Health care providers. Health care providers must obtain a health care parking permit to park their vehicles within the Borough during the times they are rendering assistance and/or health care service to residents of the Borough.

a. 
Application for parking permits under this section shall be made in writing on forms provided to the Borough Police Chief or his/her designee. Permits shall be granted only under the following terms and conditions:
1. 
Residents. To persons who are residents, a permanent permit valid for two years shall be issued for every vehicle owned or principally operated by such person.
2. 
Visitors. Two visitor tag permits shall be issued to each resident requesting them for use only by visitors to that residential unit.

a. 
The provisions of this section imposing a time limit on parking shall not relieve any person of the duty to observe other and more restrictive provisions prohibiting or limiting the stopping, standing, or parking of vehicles set forth in N.J.S.A. 39:4-138.
b. 
The provisions of subsection 7-3.5 (Schedule II which can be found in Chapter 7A), prohibiting parking during certain hours and days on certain streets shall remain in effect and the possession of a parking permit shall not be a defense to a violation of this section.

Any person who violates any provisions of this section shall, upon conviction thereof, be punished by a fine not exceeding $23. A separate offense shall be deemed committed on each day during or on which a new violation occurs or continues.
