No person shall commit any act or do anything in violation of
the rules and regulations contained in this section in any park or
public land in the Borough. The Council may, however, in its discretion,
temporarily suspend such rules and regulations as it shall deem advisable.

In public parks and public areas, no person shall:
a.
Permit any dog or other animal to run at large in any public park.
b.
Drive or ride a horse anywhere in any place other than upon the drives
in such park, and all horses taken into any public park shall be well
broken and at all times kept in such control that they may be easily
or quickly turned and stopped.
c.
Hunt, molest, harm, frighten, kill, trap, chase, tease, shoot or
throw any missile at any animal or bird, or have in his possession
the young of any wild animal or the eggs or nest of any birds.
d.
Fish in any of the waters in any public park except waters that may
be designated for such purpose by the Superintendent of Public Works.

In public parks and public areas, no person shall:
a.
Loiter in an unlighted vehicle in any unlighted area between sunset
and sunrise.
b.
Park a vehicle in other than established or designated parking areas
during daylight hours.
c.
Wash or service any automobile or truck or other vehicle.
d.
Park or stand a taxicab or other vehicle used for the transportation
of passengers for hire, for the purpose of picking up passengers.
e.
Drive a commercial motor vehicle used to carry goods, wares, merchandise
or rubbish upon any part of any public park.
f.
Operate minibikes, snowmobiles or any other motorized equipment,
save automobiles, within any conservation, recreation or park area.
(Automobiles shall be permitted to be driven only on designated roadways.)

In public parks and public areas, no person shall:

In public parks and public areas, no person shall:
a.
Dump, deposit or leave any bottles, broken glass, ashes, paper, automobile
parts, boxes, cans, dirt, rubbish, waste, garbage or refuse or other
trash, and fail to place such materials in a receptacle placed for
such purpose.
b.
Throw, discharge or otherwise place or cause to be placed in the
waters of any fountain, pond, lake or stream, or other body of water
in or adjacent to any part of any tributary, stream, storm sewer or
drain flowing into such water, any substance or thing, liquid or solid,
which will or may result in pollution of such water.
c.
Drop, throw or otherwise scatter lighted matches, burning cigarettes
or cigars, tobacco paper or other inflammable material, or light,
build, kindle or maintain any fire except in places provided for such
purpose.
d.
Throw debris on the ice of any lake or pond.
e.
Dump or otherwise deposit earth, street sweepings or other landfill
materials.

In public parks and public areas, no person shall:
a.
Gamble or participate in or abet any game of chance.
b.
Engage in loud, boisterous, threatening, abusive, insulting or indecent
language.
c.
Commit any indecent act.
d.
Carry, possess, dispense or consume any intoxicating liquors, including
wine and beer.
e.
Disturb or interfere unreasonably with any person occupying any area
or participating in any activity under the authority of a permit.
f.
Willfully mark, deface, disfigure, injure, tamper with, displace
or remove any building, bridge, table, bench, fireplace, railing,
paving or paving material, water line or other public utility or paths
or appurtenances thereof; signs, notices or placards, whether temporary
or permanent; monuments, stakes, posts or other boundary markers or
other structures or equipment, facilities or public property or appurtenances
whatsoever, real or personal.
g.
Swim or bathe in any area other than the swimming area properly posted
as such.
h.
Expose or offer for sale any article or thing, nor station or place
any stand, cart or vehicle for the transportation, sale or display
of any such article, unless by special permission of the Borough Council
or its designate.
i.
Picnic or lunch in a place other than those designated for that purpose.
j.
Cause any substance or material to be emptied into any body of water
by any means, or tamper with a dam whereby normal water levels will
be altered.
k.
Paste, glue, tack or otherwise post any sign, placard, advertisement
or inscription, whether temporary or permanent.
l.
Dig, trench or excavate any earth materials by tool, blasting or
by any other means.
m.
Beg or solicit any subscriptions or contributions of any kind, or
tell fortunes.

All public parks of the Borough shall open at sunrise throughout
the year. All public parks of the Borough shall close at sunset throughout
the year.

Playgrounds and recreational areas shall be any areas designated
by the Mayor and Council within the limits of the Borough which are
opened to the public, irrespective of whether such areas shall be
owned by the Borough.

The following regulations shall apply to playgrounds and recreational
areas:
a.
Injuring, Defacing or Removing Park Property Prohibited. No person
shall injure, deface, displace, remove, destroy or tamper with any
property, walks, pathways, facilities or equipment of any nature or
of any kind located in or about any playground or recreational area.
b.
Injuring or Setting Fire to Plants Prohibited. No person shall destroy,
cut, injure or remove any growing things, plant, growth or any branch
thereof; or set fire, or assist another to set fire, to any timber,
shrubs, plants, flowers, grass or plant growth, except at such time
when permission to do so shall have been given by proper authority.
c.
Playing of Games Restricted. No person shall play baseball, softball,
football or any other sport except in areas designated for any such
activity and under such rules and regulations as may be prescribed
by the Mayor and Council.
d.
Selling or Offering for Sale Restricted. No person shall offer to
sell, or sell, any object or merchandise or any other thing, in any
playground or recreational area, unless a permit is first obtained
therefor from the Borough.
e.
Removal of Turf or Other Materials Prohibited. No person shall take,
dig, remove or carry away any sward, gravel, sand, turf, or earth
in any playground or recreational area.
f.
Discarding Ashes or Rubbish Prohibited. No person shall take into,
carry through, leave in or throw, cast, lay, drop, or discharge into
or on, or suffer or permit any servant, agent, employee or person
in his charge to take into, carry through, leave in or throw, cast,
lay, drop or discharge into or on, the playground or recreational
areas, any ashes or rubbish or any sort of sick, diseased or dead
animals, organic refuse or any other offensive matter.
g.
Presence of Animals Prohibited. No dogs or any other animals shall
be permitted in any playground or recreational areas.
h.
Use of Intoxicating Beverages Restricted. No person shall sell, buy,
exchange, offer or solicit for sale, consume, use, carry or possess
any alcoholic beverages except by permission of the Borough, which
shall not be unreasonably withheld. Such permission, however, is subject
to the regulations of the Alcoholic Beverage Control Commission and
the laws of the State of New Jersey.[1]
i.
Littering Prohibited. No person shall scatter, drop or leave in any
portion of the playground or recreational areas, except in the receptacles
provided for the purpose, any paper, rags, garbage, dead flowers or
any other rubbish or refuse.
j.
Posting, Disturbing, Displaying of Advertising Matter Restricted.
No person shall post, paste or affix any sign, placard, notice or
advertisement of any nature on any tree, plant, building, pole, equipment
or any other structure or fixture.
No person shall distribute any circulars, cards, or any other
signs or written, printed, or manufactured matter without first receiving
permission from the Borough, which permission shall not be unreasonably
withheld.
k.
Interfering with Water Facilities Prohibited. No basin, pool, lake
or fountain in any playground or recreational area shall be fouled
by stone, wood or other substance, nor bathed in, nor waded into,
excepting wading pools designated as such by the Mayor and Council
and under such rules and regulations as shall be prescribed by the
Mayor and Council.
l.
Annoyance of Playground or Recreational Area; Animals Prohibited.
No person shall molest or in any manner disturb or annoy any animal
or fish or fowl which may be placed in any fountain, pool, basin,
or enclosure of any playground or recreational area.
m.
Picnics, Sale of Refreshments Restricted. No picnics may be held
upon or in any playground or recreational areas except in those sections
set apart for that purpose. No refreshments of any kind shall be sold
or offered for sale in connection with a picnic without first obtaining
permission from the Borough.
n.
Disorderly Conduct Prohibited; Promulgation of Rules Authorized.
Indecent exposure of the person, disorderly conduct, objectionable
noise, riot, breach of peace, and use of profane language is expressly
forbidden in the playground and recreational areas.
The Mayor and Council shall, in its discretion, prescribe rules
for the proper use of the playground and recreational areas, and a
violation of those rules shall be deemed a violation of this section.
o.
Permit Required for Assemblies. No person shall hold, conduct, or
address any public assemblage or take part in any public debate, without
first obtaining permission from the Mayor and Council, which permission
shall not be unreasonably withheld.
No exhibitions, concerts, or entertainment shall be given in
any playground or recreational area or place without first obtaining
permission from the Mayor and Council, which permission shall not
be unreasonably withheld.
p.
Discharge of Firearms Prohibited. No person shall discharge or fire
any weapon of any kind within playground or recreational areas.
q.
Discharge of Fireworks Restricted. No person shall fire, discharge
or set off any rocket, cracker, torpedo, squib, or any firework of
any kind containing any substance of explosive character of any kind
or nature. This prohibition shall not prevent special fireworks exhibitions
to be given under the auspices or direction of the Borough upon special
permit issued by the Mayor and Council and in accordance with Borough
ordinances pertaining thereto.
r.
Fires Restricted. No person shall kindle or make or build any fire
except in a picnic grille or fireplace expressly provided for that
purpose. Any fires kindled, made or built not in grilles or fireplaces
expressly provided for that purpose shall be made only after first
obtaining permission from the Borough.
s.
Missiles Prohibited. No person shall throw stones or any other missiles
that may inflict bodily harm or property damage.
t.
Vehicle Regulations. No vehicles of any kind are permitted in the
playground or recreational areas except as authorized for maintenance
or construction purposes, or except upon such paths as may be expressly
designated therefor.
u.
Gambling Prohibited. Betting or gambling of any form as well as the
maintaining of any gambling equipment or devices is prohibited.

No person shall remain, stay or loiter in any playground or
recreational areas between sunset and sunrise.
No person shall be convicted of the violation of this provision
unless a police officer or any person having all of the power and
authority of police officers under 40:12-6 or under any other statutory
provision, has first ordered such person to move on and leave and
the person has refused to do so.

a.
Establishment. The following described parcel is hereby established
as a recreational facility available to the public for recreational
activities in accordance with the terms set forth herein:
1.
Block 45, Lot 1, on the current Tax Assessment Map of the Borough,
the same being located at Redneck Avenue.
b.
Power to Lease Land. The Mayor and Council are hereby empowered to
acquire by lease any land within the confines of the Borough, and
entrances to and exits from any such lands, for the purpose of making
the same available to the public for recreational activities. Any
such lease shall be for such a period of time and upon such terms
and conditions as the Mayor and Council shall determine by Resolution.
c.
Hours of Use. Any resident, organization or appropriate group of
the Borough may utilize the hereinafter set forth Borough recreational
facility between the hours of 9:00 a.m. and 8:00 p.m. upon securing
a permit therefor.
This section is not intended to apply to informal groups of
residents who may utilize the said Borough recreational facility on
an intermittent basis.
d.
Issuance of Permits. Permits shall be issued by the Mayor and Council
or its authorized designee upon written application therefor and payment
of the required fee.
e.
Application for Permit.
1.
Application shall be made on forms approved by the Borough Clerk
and shall set forth the name and address of the applicant, fee to
be charged and those items set forth in paragraphs 2 and 3 hereinbelow.
2.
Appropriate insurance coverage shall be provided for by each applicant
naming the Borough and the Port Authority of New York and New Jersey
as named insureds thereon in an amount and form established by the
application document set forth in paragraph 1 above. A copy of the
insurance certificate must accompany the completed application.
3.
Each applicant shall be obligated to sign an Indemnification and
Hold Harmless Agreement on forms provided by the Borough.
