Pursuant to Section 11 of the Uniform Fire Safety Act (P.L.
1983, c. 383) the New Jersey Uniform Fire Code shall be locally enforced
in the Borough.

The local enforcing agency shall be the Bureau of Fire Prevention
in the Borough of Moonachie.

The local enforcement agency shall enforce the Uniform Fire
Safety Act and the codes and regulations adopted under it in all buildings,
structures and premises within the established boundaries of the Borough,
other than owner-occupied one and two family dwellings, and shall
faithfully comply with the requirements of the Uniform Fire Safety
Act and the Uniform Fire Code.

The local enforcing agency established by subsection 12-1.2 of this section shall carry out the periodic inspections of life hazard uses required by the Uniform Fire Code on behalf of the Commissioner of Community Affairs.

The local enforcing agency established by subsection 12-1.2 of this section shall be under the direct supervision and control of Chief of the Bureau of Fire Prevention who shall be the Fire Official.

a.
Appointment of Fire Official. The local enforcing agency shall be
under the direct supervision of a Fire Official who shall be appointed
by the Mayor and Council from among a list of three recommendations
provided by the Fire Chief and the Board of Fire Officers.
b.
Term of Office. The Fire Official shall serve for a term of two years
beginning January 1 of the appointing year.
c.
Inspectors and Employees. Such inspectors and other employees as
may be necessary in the local enforcing agency shall be appointed
by the Mayor and Council upon recommendation of the Fire Official.
d.
Removal from Office. Inspectors and other employees of the enforcing
agency shall be subject to removal by the Mayor and Council for inefficiency
or misconduct. Each inspector or employee to be so removed shall be
afforded an opportunity to be heard by the appointing authority or
a designated hearing officer.

Pursuant to Sections 15 and 17 of the Uniform Fire Safety Act,
any person aggrieved by any order of the local enforcement agency
shall have the right to appeal to the Construction Board of Appeals
of Bergen County.

The inspection and fees required pursuant to the Act and regulations
of the Department of Community Affairs shall be required.

All commercial and industrial businesses within the Borough
of Moonachie shall register with the Bureau of Fire Prevention of
Moonachie annually. The annual registration/inspection fee shall be

Any person, corporation or business entity violating subsection 12-1.9 shall be subject to a fine of not less than $300 and not more than $500.

The Fire Official, with the approval of the Chief Executive
Officer of the Fire Department and the Chief of Police of Moonachie,
may designate fire lanes on private property to which the public is
invited or which is devoted to public use, if it is necessary to provide
safety for the public or to provide proper access for Fire Department
operations in the event of an emergency.

Whenever a determination has been made for fire lane designation, pursuant to subsection 12-3.2, the Fire Official shall notify the owner of the property in writing by registered or certified mail, or by hand delivering such notice, specifically describing the area designated and the reason for making the designation. Any signs designating the fire lanes shall be as directed by the Fire Official and same should be erected at the sole cost of the property owner.

It shall be a violation of this section for any person to park
a motor vehicle in or otherwise to obstruct a fire lane.

This section shall be enforced by the Borough Police Department and any person who shall violate any of the provisions of this section shall, upon conviction, be liable to the penalty in Chapter 1, Section 1-5. In addition to the penalty provided, any vehicle parked in violation of the regulations provided under this section may at the direction of the Police Department be summarily towed away. Any fines imposed will be collected by the Violations Clerk.

Nothing in this section shall be deemed as the acceptance for
public use of any of the premises in any such parking area or in any
way create any public easement therein.

The Governing Body of the Borough of Moonachie finds that in
order to better protect the property and welfare of certain businesses,
business patrons and Fire Company members, a uniform system for rapid
entry into certain buildings in the event of a report of a fire emergency
is required.

The following structures or buildings shall be required to have installed
a rapid entry box system.
1.
Any industrial or warehouse building or structure.
2.
Hotels, motels or multiple dwellings which have locked main entrances
at any time during the day or night or which have locked boiler rooms,
electrical rooms, basements, sprinkler control rooms or elevator control
rooms.
3.
All educational and day-care buildings or structures.
4.
All mercantile buildings and structures including shopping centers.
5.
All office buildings and structures.
6.
All buildings and structures of public assembly including houses
of worship and restaurants.

a.
AFFECTED STRUCTURES OR AFFECTED BUILDINGS
MULTIPLE DWELLINGS
RAPID ENTRY BOX SYSTEM
The following words used in this section shall have the meanings
set forth below unless the context in which it is used clearly requires
a different meaning:
Shall mean any of the structures or buildings described in subsection 12-3.2 above.
Shall mean a residential building containing three or more
dwelling units.
Shall mean a locking vault-like container permanently mounted
into the affected structure or building and accessible from outside
of such structure or building.

Each affected building or structure shall cause an appropriate
rapid entry box to be permanently mounted into the structure or building
and accessible from outside the structure or building. Each rapid
entry box shall be of sufficient size and configuration to allow the
required contents as set forth below to be conveniently stored therein.
In order to assure acceptability of the rapid entry box chosen, each
owner, tenant, or other responsible party of each affected structure
or building shall receive approval from the Moonachie Fire Official
as to the size, type and configuration of the proposed rapid entry
box.

The location of the outside of the building or structure at
which the rapid entry box is to be located must be, as nearly as possible,
uniform amount similar type structures in order to promote quick accessibility
upon arrival of fire personnel at the scene of an emergency. Given
differing structural characteristics of different types of structures
and buildings, the location of the rapid entry box on the exterior
of each building or structure shall be submitted to and approved by
the Borough Fire Official.

The rapid entry box for each building or structure shall contain
a separately and clearly labeled key for each locked area within the
building or structure (for example, boiler rooms, electrical rooms,
sprinkler control rooms, elevator control rooms, etc.), the building
plan of any structure or building in excess of 30,000 square feet,
sprinkler keys, elevator keys, and information concerning any hazardous
materials contained with the building or structure, and a clear indication
as to the part of the building or structure within such hazardous
materials are contained.

Compliance with the provisions of this section must be achieved
on or before January 1, 2012.

As used herein, "master key" shall mean the instrument used
to gain access to the various rapid entry system boxes to be utilized
as a result of the provisions of this section. The Fire Department
shall establish a system of security and procedure to limit access
to any master key(s) to authorized personnel in times of emergency.
The Fire Department shall, to the extent feasible and practical, use
the latest technological advances available to preserve and enhance
the security of the master key(s).

Violation of the provisions of this section shall be punishable
by a $100 fine for the first offense and a $500 fine for each subsequent
offense. All enforcement of this section will be conducted by the
Fire Official or his designated Fire Inspectors, Fire Chief, and Fire
Subcode Official.
