Pursuant to the provisions of R.S. 40:55D-1 et seq., known as the "Municipal Land Use Law" and herein called the "Act," there is hereby created a Planning Board which shall be composed of nine members.

The Planning Board hereby created shall have and exercise all the powers, duties and procedures prescribed by the Act for Planning Boards, or necessarily implied therefrom, and shall have further powers, duties and procedures prescribed by ordinance, adopted pursuant to options permitted by the Act.
In addition, the Planning Board pursuant to the provisions of N.J.S.A. 40:55D-25(c) shall exercise, to the same extent and subject to the same restrictions, all powers of a Board of Adjustment. In accordance with the requirements of the Municipal Land Use Law at N.J.S.A. 40:55D-25, Class I and the Class III members shall not participate in the consideration of applications for development which involve relief pursuant to subsection d of N.J.S.A. 40:55D-70.

The Board shall consist of the following classes:
Class I. The Mayor or the Mayor's designee in the absence of the Mayor.
Class II. One of the officials of the Township other than a member of the Township Committee to be appointed by the Mayor.
Class III. A member of the Tabernacle Township Committee.
Class IV: Six other citizens of the Township to be appointed by the Township Committee.
The members of Class IV shall hold no other municipal office except that one such member may be a member of the Board of Education. A member of the Environmental Commission who is also a member of the Planning Board as required by N.J.S.A. 40:56A-1 shall be a Class IV Planning Board member.
Positions for two alternate members to the Planning Board pursuant to N.J.S.A. 40:55D-23.1 are hereby created. The position of two alternate members of the Planning Board shall be appointed by the Township Committee and such alternate members shall meet the same qualifications as Class IV members of the Planning Board. Alternate members shall be designated at the time of appointment by the Mayor as Alternate No. 1 and Alternate No. 2. The terms of the alternate members shall be for two years except that at the time of initial appointment, one of the alternate members shall be appointed for a term of one year so that the term of not more than one alternate member shall expire in any one year. A vacancy occurring otherwise than by expiration of a term shall be filled by the appointing authority for the unexpired term only.

There is hereby created the office of Planning Board Attorney. The Planning Board may annually appoint, fix the compensation of or agree upon the rate of compensation of the Planning Board Attorney who shall be an attorney other than the Township Attorney, in an amount not exceeding the amount appropriate by Township Committee for such purpose.
