As used in this Article, the following terms shall have the meanings indicated:
BEE
Any stage of the common domestic honey bee, Apis Melifera Species.
COLONY
A hive and its equipment and appurtenances, including bees, comb, honey, pollen, and brood.
HIVE
A structure intended for the housing of a bee colony.

A. 
Beekeepers shall seek to comply with the best management practices for Missouri beekeepers as developed by the Missouri State Beekeepers Association (MSBA).
B. 
All bee colonies shall be kept in inspectable-type hives with removable combs, which shall be kept in sound and usable condition.
C. 
Hives are not permitted within ten (10) feet of a lot line as measured from the closest point of any lot line to the closest point of the hive.
D. 
Hives shall be located only in the rear yard.
E. 
Any hive within twenty-five (25) feet of a lot line shall not open towards that lot line unless that lot line shall have a flyway barrier of at least six (6) feet in height. The flyway barrier shall consist of one (1) or a combination of the following: vegetative barrier, solid wall, fence, or other acceptable barrier that meets the intent of this Section as determined by the Planning Director.
F. 
No hive is permitted within ten (10) feet of a building used for human habitation on an adjoining lot as measured from the closest point of such building to the closest point of the hive.
G. 
Each beekeeper shall ensure that a convenient source of water is available at all times. The water source shall be located on the same property as the hive; not located within ten (10) feet of a lot line as measured from the closest point of the lot line to the closest point of the water source; and shall be located within fifty (50) feet of the hive or less than one-half (1/2) the distance to the nearest unnatural water source, whichever is closest. The water shall be maintained so as not to become stagnant.
H. 
Beekeepers shall practice good swarm prevention techniques.
I. 
It shall be unlawful to keep more than five (5) colonies on any lot within the City. Exception: Splits are permitted on a temporary basis.
J. 
Bees, hives, and the area surrounding the hives shall be maintained so that they do not create a nuisance.
K. 
For the purpose of Article VI bees are animals.
L. 
Existing beekeepers shall be granted an extension for compliance with the location of any hive up to and including January 1, 2021.
