Pursuant to Section 11 of the Uniform Fire Safety Act, N.J.S.A.
52:27 D-202, the Uniform Fire Safety Code shall be locally enforced
in the Borough of Jamesburg.

The local enforcement agency shall be the Bureau of Fire Prevention,
which is hereby created in the Department of Public Safety, Division
of Inspections.

The Bureau of Fire Prevention shall be part of the Department
of Public Safety, Division of Inspections, and shall be under the
direct supervision and control of the Chief Code Enforcement Officer,
who shall be the Fire Official.

The Fire Official and inspectors shall be appointed by the Mayor
and Council and shall serve for a term of four years. The Fire Official
and inspectors of the enforcement agency shall be subject to removal
by the Mayor and Council for inefficiency or misconduct only after
public hearing.

The Bureau of Fire Prevention shall enforce the Uniform Fire
Safety Act and the codes and regulations adopted under it in all buildings,
structures and premises within the established boundaries of the Borough,
other than owner-occupied one and two family dwellings, and shall
faithfully comply with the requirements of the Uniform Fire Safety
Act and the Uniform Fire Safety Code.

The Bureau of Fire Prevention shall carry out the periodic inspections
of life hazard uses required by the Uniform Fire Code on behalf of
the Commissioner of Community Affairs.

The Borough Attorney is hereby appointed to assist the Bureau
of Fire Prevention to enforce the Code, as provided for N.J.A.C. 5:18A-3.2(d).

Pursuant to Sections 15 and 17 of the Uniform Fire Safety Act,
N.J.S.A. 52:27D-206 and 208, any person aggrieved by any order of
the local enforcement agency shall have the right to appeal to the
Construction Board of Appeals of Middlesex County.

In addition to the inspections and fees required pursuant to the Act and the regulations of the Department of Community Affairs, the following additional annual inspections shall be required for, other than life hazard uses, with the fees therefor as set forth in Section 12-2:
a.
Food Service Uses. At use group classifications, except residential,
wherein cooking equipment is used for the preparation of food for
service to the public for either on-premises consumption or off-premises
consumption.
b.
Business Uses. At business use group occupancies with a gross floor
area, all floors, of 2,500 square feet or greater.
c.
Storage Uses. At storage use group occupancies with a gross floor
area of 2,000 square feet or greater.
d.
Mercantile Uses. At all mercantile use group occupancies regardless
of size or area.
e.
Factory Uses. At all factory use group occupancies regardless of
size or area.
f.
Multi-Family Common Areas. At all common areas of multi-family use
group occupancies.

a.
Established. The fees for the various use group inspections shall be as set forth in Section 12-2.
b.
When Due. The inspection fee shall be paid to the Borough annually
by the individual, firm or corporation, as the case may be, during
the period of January 2nd through January 31st of each year, and filed
along with a registration form supplied by the Borough.

Where an individual, firm or corporation requests an inspection to be conducted, other than those required by this Code, for the purpose of obtaining a record of such inspection, the fee shall be as set forth in Section 12-2.

The fee for a certificate of fire code status shall be as set forth in subsection 12-2.

The limits in which storage of flammable liquids in outside
aboveground tanks is prohibited are hereby established as the entire
Borough.

The limits in which storage of explosives and blasting agents
is prohibited are hereby established as the entire Borough.

The Mayor, the Chief of the Fire Department and the Fire Marshall
of the Bureau of Fire Prevention shall act as a committee to determine
and specify, after giving affected persons an opportunity to be heard,
any new materials, processes or occupancies which shall require permits,
in addition to those now enumerated in the Code. The Chief of the
Bureau of Fire Prevention shall post such list in a conspicuous place
in his office and distribute copies to interested persons.

a.
The Bureau of Fire Prevention, upon approval of the Borough Council
in the form of an ordinance, is authorized to establish fire areas
on property devoted to public use, including, but not limited to shopping
centers, bowling alleys, churches, swimming pools and similar uses
involving parking of sufficient number of motor vehicles to make necessary
such regulation for protection of persons and property in case of
fire or other emergency.
b.
The fire areas shall be established to insure fire equipment and
other emergency vehicles unobstructed means of ingress and egress
to such properties and the buildings, persons, vehicles, fire hydrants
and stand-pipes thereon in case of fire or other emergency.
c.
The number, location, width, length and markings of such areas shall
be determined by the Bureau of Fire Prevention with the approval of
the Borough Council. Such determination and approval shall be by ordinance
based upon the size, type and location of the building or buildings,
use to which the property is put, number of motor vehicles, operated
or parked upon the property, the number of persons using and occupying
the premises, existing means of ingress and egress, the total area
of the property, including size of the parking lot or lots, and all
other relevant factors.
d.
The Bureau of Fire Prevention is further authorized, with the approval
of the Borough Council by ordinance, to regulate, restrict and prohibit
the parking and operation of motor vehicles in and near such fire
area, and to impose other regulations necessary to insure that such
areas are free from obstruction.
e.
The Police Department shall have the concurrent jurisdiction together
with the Bureau of Fire Prevention to enforce the provisions of this
section.

a.
Purpose. The Governing Body of the Borough of Jamesburg finds that
in order to better protect the property and welfare of certain businesses,
business patrons and fire company members, a uniform system for rapid
entry into certain buildings in the event of a report of fire emergency
is required.
b.
Definitions. The following terms, as used in this subsection, shall
have the meanings set forth below unless the context in which it is
used clearly requires a different meaning.
1.
AFFECTED STRUCTURES OR AFFECTED BUILDINGS - Shall mean any of the
structures or buildings described in paragraph c below.
2.
RAPID ENTRY BOX SYSTEM - Shall mean a locking, vault-like container
permanently mounted into the affected structure or building and accessible
from outside of such structure or building.
c.
Applicability. All commercial buildings or structures protected by
fire suppression systems or fire alarms, and all other buildings or
structures as required by the Borough Fire Official, shall provide
a rapid entry box system or other locking device approved by the Borough
Fire Official. The rapid entry box system shall contain keys to provide
access to all areas of the building or structure and shall be installed
in a location(s) approved by the Borough Fire Official, such rapid
entry box shall only be utilized in response to a report of a fire
or fire protection system activation or other emergency call from
the Police Communications Center.
e.
Type of Rapid Entry Box Required. Each affected building or structure
shall cause an appropriate rapid entry box to be permanently mounted
into the structure or building and accessible from outside the structure
or building. Each rapid entry box shall be of sufficient size and
configuration to allow the required contents as set forth in paragraph
g below to be conveniently stored therein. In order to assure acceptability
of the rapid entry box chosen, each owner, tenant, or other responsible
party of each affected structure or building shall receive approval
from the Borough Fire Official as to the size and configuration of
the proposed rapid entry box.
f.
Location of Rapid Entry Box. The rapid entry box shall be provided
with a monitored tamper switch and shall be located in a lighted location,
seven feet above grade, in a location approved by the Borough Fire
Official.
g.
Required Contents of the Rapid Entry Box. The rapid entry box for
each building or structure shall contain a separately and clearly
labeled key for each locked area within the building or structure
(i.e. boiler rooms, electrical rooms, sprinkler control rooms, elevator
control rooms, etc.)
h.
Compliance Deadline. Compliance with the provisions of this section
shall be achieved within six months of the adoption of this subsection.
i.
Master Key Security. As used herein, the master key shall mean the
instrument used to gain access to the various rapid entry system boxes
to be utilized in accordance with the provisions of this subsection.
The Borough Fire Official shall establish a system of security and
procedure to limit access to any master key(s) to authorized personnel
in times of emergency.

Each property will be inspected on an annual basis. The permit
fee shall be as set forth in the Borough Schedule of Fee Ordinance
on file in the office of the Borough Clerk.

a.
Registration Permits. Registration permits are required on all commercial
properties and/or businesses located within the jurisdiction of the
Borough of Jamesburg. Registration permits shall be required on all
commercial and other public places not outlined or falling under the
life hazard use category. It shall include but not be limited to the
following: mercantile, professional office, business office, warehouse,
storage building, eating establishment, bank, church, maintenance
building, clubhouse. All properties and/or businesses.
The fees for registration permits are due in the month of January
of each year. Those fees not received in the office of the Fire Prevention
Bureau within one month of dated invoices are subject to a late penalty
of that equal to and including the registration fee for that year.
All fees are as set forth in the Borough Schedule of Fee Ordinance
on file in the office of the Borough Clerk.

A Certificate of Smoke and Carbon Monoxide Detector Compliance
will not be issued until all fees have been paid to the Jamesburg
Fire Prevention Bureau.
