An auction, within the meaning of this chapter, shall be held to include any public sale of property to the highest bidder.

No sale of real or personal property by auction except sales under legal process, shall be made by any person other than an auctioneer who shall first have obtained a license from the Village Clerk and paying the fee as provided in Section 29-11, and having executed a bond to the Village as hereinafter provided.

Any person desiring an auctioneer's license shall file a written application therefor which shall conform to Chapter 29 relating to applications for licenses.

No person shall receive a license to sell goods at auction in the Village until he shall first have executed to the Village a bond in the penal sum of $200, with the two or more sureties residing within the Village, conditioned for the strict observance of all ordinances of the Village respecting auctions and auctioneers.

No license issued trailer the provisions of this chapter shall be transferable, or be held to authorize any person other than the one named therein, or his agent or servant to sell or cry goods at auction and such agent or servant shall only be authorized to auction goods when it may be necessary to rest his employer or when from sickness or other emergency such employer is unable to do the business himself, and in no case shall any license be held to authorize any two persons to sell under it at one and the same time, or to cover more than one place of business, or to authorize an auction at any other place of business than the regular place of business of the person receiving such license, if he has such regular place; provided, that any auctioneer may, by first notifying the President and Board of Trustees change the location of his place of business, in which case the license shall be held to cover such new place; and, provided further, that any licensed auctioneer may temporarily leave his regular place of business and sell any property which can not conveniently be removed to such place of business, wherever such property is situated.
Any auctioneer who shall procure any person to make a fictitious bid at any auction sale of real or personal property, or who shall conspire with any person to make a fictitious bid at any such auction sale, or who shall knowingly permit any person to make a fictitious bid at any such auction sale, or any auctioneer, who shall himself fictitiously raise any bid at any such auction sale, shall be punished as provided for in Section 13-3, and the license of such auctioneer shall be revoked.
Any auctioneer or person present when any article is offered for sale who shall knowingly, with the intent to induce any person to purchase the same, or any part thereof, make any false representation or statement as to the ownership of or the character or quality of the article offered for sale, or as to the poverty or circumstances of the owner, or pretended owner of such article, shall on conviction be punished as provided for in Section 13-3, and his license shall be forfeited.

Whoever shall exhibit and offer for sale at auction any article, and shall induce purchase by any bidder, and shall afterwards secretly substitute any other article for that one so exhibited, or in the making of any auction sale shall be guilty of any device, trick or fraudulent practice, with intent to deceive or defraud any bidder, shall be punished as provided in Section 13-3 of this Code, and the license of such person shall be revoked.
No person shall use any sound system or use any system of flashing lights or other means of signals to attract attention to any public auction.
