It shall be the duty of the Chief of Police, the Borough Clerk, the Mayor and Borough Council and any police officer of the Borough of Barrington to examine all places of business and all persons of the Borough of Barrington to determine if this chapter has been complied with and to enforce the provisions of this chapter against any person found to be violating the same. Further, it shall be their duty to require any person seen peddling, soliciting, canvassing or distributing and who is not known by such officer to be duly licensed to produce his peddler's, solicitor's, canvasser's or distributor's license, as the case may be, and to enforce the provisions of this chapter against any person found to be violating the same.
No license shall be required of any person for any mere delivery in the Borough of Barrington of any property purchased or acquired in good faith from such person at his regular place of business outside the Borough where no intent by such person is shown to exist to evade the provisions of this chapter.
The Borough Council of the Borough of Barrington may authorize the issuance of special permits, without the payment of any license fee or other charge therefor, to any public, charitable, educational, literary, fraternal or religious organization having its location in the Borough of Barrington for the conduct or operation of a temporary nonprofit enterprise for a public, charitable, educational, literary, fraternal or religious purpose. Applicant, however, shall submit the usual application form in the manner as hereinbefore required and shall operate, if granted a permit, in accordance with the requirements of this chapter.
Any permit or license granted or issued pursuant to this chapter may be revoked by the Borough Council, after notice and hearing, for any of the following causes:
A. 
Any fraud, misrepresentation or false statement made in connection with the selling of goods, wares or merchandise.
B. 
Any fraud, misrepresentation or false statement contained in the application for license.
C. 
Any violation of this chapter.
D. 
Any conviction of the licensee of any felony or of a misdemeanor involving moral turpitude.
E. 
Conducting the business licensed under this chapter through application himself or any of his agents, servants or employees in any unlawful manner or in such a manner as to constitute a breach of peace or to constitute a menace to the health, safety or general welfare of the public.
A. 
Notice of hearing for revocation of a license under § 49A-21 preceding shall be given in writing by the Borough Clerk, setting forth specifically the grounds of complaint and the time and place of the hearing.
B. 
Service of notice.
(1) 
In the event of a notice of hearing for revocation of a license under this chapter, notice shall be served upon the licensee as determined from the forms submitted by the licensee under §§ 49A-6 and 49A-15, either personally or by mail. In the event of service by mail, it shall be made by registered or certified and by regular mail. Service by mail shall be considered valid unless all of the mailings are returned by the post office. If all of the mailings are returned undeliverable, service shall be accomplished by posting the notice at the licensed property.
(2) 
Personal service of the notice is valid upon personal service of the violation notice upon a member of the family of the licensed property owner over 14 years of age, residing in the same dwelling as the owner.
(3) 
In the event that personal service cannot be made, or in the event that service by certified mail is not accepted, service shall be accomplished by posting said notice in a conspicuous place on the licensed premises.
In addition to the provisions for revocation, the Borough Clerk, the Chief of Police, any police officer of the Borough of Barrington or any taxpayer or resident of the Borough may make complaint in the Municipal Court of the Borough of Barrington for any violation of this chapter or any article, section, subsection or provision thereof. Upon conviction in such case, for each and every violation or violations, a violator shall be subject to penalties as set forth in § 1-15 of the Code of the Borough of Barrington. Each day that a violation is permitted to exist shall constitute a separate offense.
