The current Chapter 26, Part 1, of the Code of Ordinances of the Borough of New Stanton, known as the "New Stanton Stormwater Management Ordinance," is hereby repealed and replaced by this chapter, which shall be placed in Chapter 26, Part 1, of the Code of Ordinances of the Borough of New Stanton; and be titled as the "New Stanton Stormwater Management Ordinance."

With the exceptions of those provisions in the prior ordinance, set forth above in Subsection 1, wherein and whereby the Borough previously approved stormwater plans for developments, lands and land developments, which stormwater plans were designed, constructed, installed and completed; and/or are and have not been properly maintained, repaired, replaced and operated in strict compliance with all of the standards, specifications, rules, regulations, ordinances and requirements of the Borough's prior Stormwater Management Ordinance (collectively "provisions"), shall continue to apply to those prior approved stormwater plans.

If any of the prior stormwater plans approved under the prior Stormwater Management Ordinance that have not been timely, fully and completely designed, constructed, installed and completed; and are and have been properly maintained, repaired, replaced and operated in strict compliance with all of the standards, specifications, rules, regulations, ordinances and requirements of the Borough's prior Stormwater Management Ordinance (collectively "provisions"), and/or are not being properly maintained, repaired, replaced and operated in strict compliance with all of the standards, specifications, rules, regulations, ordinances and requirements of the Borough's prior Stormwater Management Ordinance (collectively "provisions"), then the provisions of this chapter shall apply.

The current provisions in Chapter 22, Parts 6 and 7, in the Code of Ordinances of the Borough of New Stanton, dealing with stormwater, that are inconsistent with any of the provisions in this chapter are:
A. 
Hereby repealed to the extent of the inconsistency;
B. 
Replaced by this chapter; and
C. 
Construed in pari materia between the provisions set forth in § 22-615, Subsection 12., in the Codification of the Borough of New Stanton, and construed together with § 26-604, Municipal Stormwater Facility and BMP Operation and Maintenance Fund, in this chapter.
