To promote public safety and the welfare of the inhabitants of the City of Belfast by regulating the use of exploding targets within the City.

As used in this article, the following terms shall have the meanings indicated:
DETONATE
To explode with violence and/or noise.
EXPLODING TARGET
Any device which explodes upon impact by a projectile fired from a firearm. This includes and is not limited to binary exploding targets made of separately packaged fuel and oxidizer that must be mixed to make the explosive device live (such as but not limited to targets marketed under the name Tannerite, Star and Sure-shot).

It shall be unlawful for any person within the City of Belfast to detonate any exploding target as defined above.

(a) 
Upon first violation of the prohibition set forth in this article, only a warning will be issued. A civil penalty in the amount of $500 shall be imposed for any subsequent violation of prohibition set forth in this article.
(b) 
In the event an action in District Court is authorized to enforce this article, and the City is the prevailing party, the violator shall also be responsible for the attorney fees and costs incurred by the City in bringing such action.

Any law enforcement officer will enforce this article by issuing a summons and testifying in District Court to enforce the provisions of this article; and to take whatever other actions are necessary to collect any judgment. The Code Enforcement Officer shall contact the Belfast Police Department upon learning of a violation.

This article shall be effective immediately upon adoption by the City Council of the City of Belfast.
