A. 
Pursuant to § 281.57(8)(c), Wis. Stats., the Village of Whitefish Bay is authorized and directed to establish a system of equitable user charges for the operation and maintenance of the local sanitary sewer system for which the user fee system shall be in compliance with Title II of the Federal Act (Public Law 92-500)[1] amended and the rules promulgated under the Federal Act.

The purpose of this section is to enable the Village of Whitefish Bay to establish and collect from users within the municipality those charges which represent the proportionate contribution of such users (or user classes) and the user's proportionate share of the total operation and maintenance costs (including replacement costs) of the Village sanitary sewer system and the conveyance and the cost of wastewater treatment by MMSD. The system of charges shall be based upon the user's (or user classes) proportionate to the total from the users (or user classes).
A. 
It shall be the policy of the Village Board to obtain sufficient revenues to pay the costs of Village operation, maintenance, rehabilitation and replacement of the sanitary sewer system and the wastewater charges billed to the Village by MMSD. The revenues shall include any past or future debt retirement and other capital improvements as necessary to protect the health, comfort and sanitary of the Village residents. Each user of the sanitary sewer system facilities shall pay a proportionate share of the cost of such facilities.
B. 
A sewer service charge is hereby imposed on each lot, parcel of land, building or premises served by the sanitary sewer system and the MMSD water reclamation facilities, or otherwise discharging wastewater and industrial wastes into the sanitary sewer system.
C. 
Rates shall be reviewed from time to time by the Village Board. Rates shall be adjusted as required to reflect the actual number and sizes of uses and actual costs. The sanitary sewer charges shall be subject to revision based on changes in the Village costs or as a result of changes in the rates charged the Village by MMSD.
D. 
Sewer service charge and rate structure plan are approved by the Village Board and the details can be provided as requested.
