Borough of Manor, PA Part 10 REPEALER; EXCEPTIONS; REFERENCES

§ 23-1001 Repealer; Exceptions.

1. The current Chapter 23, Part 1, of the Code of Ordinances of the Borough of Manor, known as the "Manor Stormwater Management Ordinance," is hereby repealed and replaced by this chapter, which shall be placed in Chapter 23, Part 1, of the Code of Ordinances of the Borough of Manor; and be titled as the "Manor Stormwater Management Ordinance."

2. With the exceptions of those provisions in the prior Ordinance, wherein and whereby the Borough previously approved stormwater plans for developments, lands and land developments, which stormwater plans were designed, constructed, installed an completed; and are and have been properly maintained, repaired, replaced and operated in strict compliance with all of the standards, specifications, rules, regulations, ordinances and requirements of the Borough's prior Stormwater Management Ordinance (collectively "provisions") shall continue to apply to those prior approved stormwater plans.

3. If any of the prior stormwater plans approved under the prior Stormwater Management Ordinance have not been timely, fully and completely designed, constructed, installed an completed; and are and have been properly maintained, repaired, replaced and operated in strict compliance with all of the standards, specifications, rules, regulations, ordinances and requirements of the Borough's prior Stormwater Management Ordinance (collectively "provisions"), and/or are not being properly maintained, repaired, replaced and operated in strict compliance with all of the standards, specifications, rules, regulations, ordinances and requirements of the Borough's prior Stormwater Management Ordinance (collectively "provisions"), then the provisions of this chapter shall apply.

4. The current provisions in Section 22-508, dealing with stormwater, and Section 22-510, dealing with erosion and sedimentation, in the Code of Ordinances of the Borough of Manor, that are inconsistent with any of the provisions in this chapter, are hereby repealed to the extent of the inconsistency; and replaced by this chapter.
