Accumulation of snow and/or ice on Town roads presents a threat to public health, safety and welfare. In order to remove snow and ice in a timely manner while causing the least interference with traffic, the Town Highway Department frequently does so during overnight hours when there is less traffic. The purpose of this article is to regulate and control parking on Town roads to allow for safe access and passage of municipal snow removal equipment and other emergency vehicles in the Town.
This article is adopted pursuant to Municipal Home Rule Law § 10 and Vehicle and Traffic Law § 1660.
As used in this article, the following terms shall have the meanings indicated:
MOTOR VEHICLE
A passenger auto, truck, tractor truck, semitrailer tractor/cab and/or trailer, trailer, bus, motorcycle, mobile home or any other vehicle however propelled.
PERSON
An individual, an association, a partnership, a limited liability company and/or a corporation.
TOWN ROAD
Any road which is currently owned and maintained by the Town and any road which may be dedicated to and accepted by the Town in the future:
A. 
After an accumulation of snow and/or ice of two inches or more or when such an accumulation is expected to occur during the overnight hours, it shall be unlawful for any person to place, park or leave any motor vehicle on any Town road between the hours of 7:00 p.m. and 7:00 a.m. unless the motor vehicle is at all times attended by and in the charge of a person capable of operating it. All normal parking rules and regulations for Town roads shall be temporarily suspended during this time.
B. 
The Town Highway Superintendent shall determine in each instance when this prohibition will go into effect and when it is discontinued. The prohibition as well as the end of the prohibition after sufficient removal of the snow and/or ice may be announced on the Town's website or as otherwise determined by the Highway Superintendent. However, the prohibition shall automatically take effect after an accumulation of snow and/or ice of two inches or more or when such an accumulation is expected to occur during the overnight hours even if the Town has not announced the prohibition.
The provisions of this article shall not apply to physicians on emergency call, emergency vehicles, snow control vehicles, public vehicles of service or ambulances on emergency call.
Failure to comply with the provisions of this article shall be deemed a violation and may result in a traffic ticket and/or a fine and/or the vehicle being towed at the owner's expense. Any removal of a vehicle as provided herein shall not give rise to any liability for damages to the vehicle, provided that reasonable care has been taken in its removal. Any vehicle removal pursuant to this article shall be reported to the Department of Motor Vehicles as required under the Vehicle and Traffic Law.
The invalidity of any clause, sentence, paragraph or provision of this article shall not invalidate any other clause, sentence, paragraph or part hereof.
All local laws or ordinances or parts of local laws or ordinances in conflict with any part of this article are hereby repealed.
This article shall take effect upon filing by the office of the New York Secretary of State.
