All amendments to this chapter shall be in accordance with the
provisions of the Town Law of New York State applicable thereto. Any
proposed amendment shall be submitted to the Town Planning Board for
a report and recommendation prior to the required public hearing and
the final action thereon by the Town Board. At least 10 days prior
to the date of a public hearing, a notice of the time and place shall
appear in the official newspaper of the Town and the Town website.
Such notice shall describe the area, boundaries, regulations, or requirements
that such proposed change involves.
From time to time, at intervals of not more than three years,
the Planning Board shall reexamine the provisions of this chapter
and the location of district boundary lines and shall submit a report
of its findings to the Town Board.
This chapter is not intended to apply to nor govern, and it
shall not be applied to nor govern, in any case, any premises, land,
building or event located or occurring wholly within the geographical
confines of the Village of Waterford as it shall exist on the date
this chapter becomes effective.
In accordance with the §§ 239-l and 239-m of
the General Municipal Law of New York State, all proposed zoning regulations,
or any amendment thereof, which would change the district classification
of or the regulations applying to real property lying within areas
defined by the aforementioned sections and of proposed special permits
or variances affecting lands or buildings within the defined areas
shall be referred to the County Planning Agency of Saratoga County
for review and comment prior to final action by the appropriate Town
body.
