Pursuant to Article II, § 54-6, Definitions, temporary storage containers, storage units or pods shall, for the purposes of this article, be referred to as "pods." Pods shall comply with the standards established by this article together with all other applicable regulations of the Borough. Where the requirements of any part of this article conflict with any other section of the Borough Code, the provisions of this article shall prevail.
No person, corporation or other entity shall place, abandon or leave, keep or store, suffer or permit the placing, abandoning, leaving or keeping, or storage of any pods, storage containers, storage units, or storage trailers upon any public or private land in the Borough of Paulsboro or between or upon the rights-of-way of any public street or thoroughfare therein unless they do so in compliance with this article. For rental properties, see § 54-24.3, Permits, Subsection A.
Prior to the placement of a storage unit or pod on a property which a person owns, rents, occupies or controls; or on a public thoroughfare or right-of-way directly adjacent to said property, a permit shall be required for the placement of a pod at any site for any period of time longer than one day.
A. 
The owner of a site must apply to the Borough Zoning/Construction Office for a permit to temporarily place a pod on a site. Tenants may not apply for a permit; the owner of the property must apply for the permit and have it consigned by the tenant.
B. 
A permit may be issued to allow the placement of a pod on a site for an initial period of 30 days. A permit may be renewed for no more than two additional thirty-day periods upon applications for renewal by the permit holder.
C. 
The person/entity wishing to place the pod must provide a drawing for the placement of the pod. The Zoning/Construction Office may refer the permit application to the Police Department if there is a possibility of sight line interference or traffic disruption.
D. 
A permit for a pod will not be issued to any user found to be in violation of any provision of the Zoning Ordinance or in arrears on taxes or water/sewer payments until such time as the violation or violations are corrected.
E. 
Any user seeking a permit for a pod shall be required to pay a fee of $50 for the permit.
Pods shall be permitted in all residential zones subject to the following provisions:
A. 
Pods shall be placed only in the driveway, allotted parking areas or on portions of property not located in the right-of-way. No pod shall be located in any manner that obstructs sidewalks.
B. 
Only one storage trailer or pod unit may be placed on a residential property at one time.
C. 
Construction storage pods or trailers. Any construction storage trailers or pods placed on a construction site must follow the requirements of this article. In addition, construction debris and/or hazardous materials may not be stored in storage containers. An appropriate construction pod/trailer application must be completed.
D. 
Any temporary pod placement in a right-of-way or on a public throughfare will require the permit to be reviewed and approved by the Police Department.
E. 
No pod shall be located within 10 feet of a property line without express written permission of the owner of the adjoining property.
F. 
All pods shall be set back minimally 10 feet from principal buildings.
G. 
All pods shall be located in such a manner as to utilize existing buffers for the purpose of screening pods from adjoining properties.
H. 
Pods shall not be located so as to obstruct vehicle circulation, particularly emergency vehicle circulation.
I. 
Pods shall not be larger than 150 square feet in area.
J. 
Pods shall not be higher than 10 feet from grade.
K. 
Pods shall only be used by the owner or occupant of the property on which the pods are placed. Pods shall be used only to store household items and shall not be used for any commercial purpose whatsoever, nor for the storage of any items used for business purposes by any owner/occupant.
L. 
Pods shall not be used for the storage of any hazardous substance or organic material., including but not limited to chemical, flammable or explosive materials. Pods shall also not be used for the storage of trash.
M. 
Pods shall not be used for temporary habitation of humans or animals.
N. 
Pods shall not be used as pools, nor may they be filled with water for any purpose.
O. 
Upon reasonable notice to the applicant, the Borough may inspect the contents of any storage trailer or pod unit for compliance with this article.
No signage shall be placed on any pod other than signage containing the name, address and telephone number of the person or entity engaged in the business of renting the pod or placing the pod on a user's site.
A. 
All signs on pods must be permanently adhered to or painted on the pod.
B. 
There shall be no more than one sign attached to any side of a pod and no more than two signs on any pod.
C. 
No sign shall be larger than 15% of the area of the side to which it is attached.
There shall be no lighting fixtures attached to any pod, nor shall there be any lighting fixtures utilized to light the interior of a pod. Exception: There may be an exception granted by the Construction Department for construction trailers placed on a building site.
All pods shall be maintained in good condition, free from evidence of deterioration, weathering, discoloration, rust, ripping, tearing, or other unsightly condition. All pods must be locked when not being used by a user.
A. 
It shall be unlawful for any person to allow a pod to remain on a site which he or she owns, rents, occupies or controls without first obtaining a permit for said pod.
B. 
A user who allows a pod to remain at a site for longer than seven days without first obtaining a permit as required by this article shall be notified that he or she has two days to remove the pod or to obtain a permit for same.
C. 
Each day that a pod remains at a site shall subject the owner or occupant of the site to penalties, with each day that the pod remains on the site considered to be a separate violation of the provisions of this article.
D. 
Any person found to have violated a provision of this article shall be subject to the penalty provisions contained in § 54-10.2 of the Borough Code.
