There is hereby created a Department of Public Works for the Township of Lacey, County of Ocean, State of New Jersey.
A. 
There is hereby created and established in the Department of Public Works a Superintendent/Director of Public Works, who shall be designated by the Township Committee and shall receive such salary as the Township Committee may determine from time to time and shall be paid in accordance with the terms and provisions of the Salary Ordinance of the township.[1]

B. 
The Superintendent/Director of Public Works shall be appointed by the Township Committee and shall serve for a term of one (1) year, commencing on January 1 of the year of appointment and ending on December 31 of that year or until a successor has been appointed and qualified. A person holding the office of Superintendent/Director of Public Works full-time for five (5) consecutive years shall have tenure of office as provided for in N.J.S.A. 40A:9-154.6.
The Superintendent/Director of Public Works shall be responsible to the Township Committee and will perform such duties as the Township Committee may from time to time designate. The Township Committee shall appoint a member of the Township Committee to serve as liaison to the Department.
The Superintendent/Director shall:
A. 
Have full charge and management of the Department and of the other officers and employees in said Department, subject to civil service laws and subject to the legislative power of the municipality. Such charge shall include the power to hire, fire, discipline and promote employees within the Department of Public Works, subject to law.
B. 
Direct all Department operations, the maintenance and inventory of Department equipment, the preparation and administration of the Department's budget, the monitoring of all Department purchases and all other duties that the Township Committee may assign.
C. 
Render to the Township Committee such reports, recommendations, drawings or other documents as may be required, at regular stated intervals or upon special request therefor. He shall prepare and present to the Township Committee short- and long-range recommendations for improvements to the infrastructure of the township and in other areas that are within the functions and duties of his Department.
D. 
Have the authority to delegate any of the duties set forth in this chapter to any other qualified employee within his Department and shall make appropriate assignments within said Department in pursuance of this duty.
E. 
Make a final determination as to disciplinary action with respect to any employee in addition to final determination as to the granting of scheduled salary increases and authority to approve or disapprove the transfer of employees into or out of his Department, subject only to civil service laws and the legislative powers of the Township Committee.
F. 
Have complete control over the internal policies, procedures, rules, regulations and organization of the Department, subject only to the applicable statutes, and shall coordinate the work of his Department with other departments of the Township of Lacey.
G. 
Be directly accountable to the Township Committee of the Township of Lacey.
H. 
Formulate, amend or modify and recommend Department policies and procedures and rules and regulations to the Township Committee. The Township Committee may then adopt the recommended policies and procedures and/or rules and regulations by resolution of the Committee. Upon adoption, these policies and procedures and/or rules and regulations shall govern the management and operation of the Department.
I. 
Oversee the operation and administration of public docks, including coordination of requests and complaints with regard to the township docks, and periodically inspect public docks to ensure compliance with the township dock lease agreements.

The functions of the Department of Public Works shall include but not be limited to the following:
A. 
The construction and maintenance of township roads and storm drains.
B. 
The construction and maintenance of township parks, buildings, grounds, docks and lakes.
C. 
The collection and disposal of recyclable material and refuse throughout the township as is required.
D. 
The maintenance and repair of township vehicles.
E. 
Additional operations and functions as the Township Committee may from time to time designate.
In addition to the Superintendent/Director of Public Works, the Township Committee may authorize positions within the Department by ordinance as deemed necessary by the Township Committee. These additional positions shall be in accordance with the New Jersey Department of Personnel rules and regulations as promulgated within Title 11A of the New Jersey Statutes Annotated.
All current employees of the Township of Lacey who are employed in the Public Works Department, performing one (1) or more of the operations and functions designated in § 97-5, shall be deemed to be employees of the Department of Public Works.
To be appointed to the position of Superintendent/Director of Public Works, an individual must reside within the Township of Lacey or relocate as a resident of the Township of Lacey within twelve (12) months of his initial appointment. No person shall be reappointed as Superintendent/Director of Public Works if he has failed to meet the residency requirements set forth herein.
