For the purposes of this chapter, the terms used herein are defined as follows:
MOTOR VEHICLE
All vehicles propelled otherwise than by muscular power, including motorcycles, trailers of all types and tractor equipment.
PUBLIC RIGHT-OF-WAY
Any street, avenue, boulevard, highway, sidewalk or alley, waterway or similar place which is owned or controlled by a governmental entity.
Unless an approval has been obtained from the appropriate agency or Zoning or Planning Board for the conducting of the business of the sale of motor vehicles, no person shall offer for sale any motor vehicle on any private property, public right-of-way or vacant land in the Township of Lacey. This prohibition shall apply both to the owner of the property on which the violation is occurring as well as any owner of a motor vehicle being offered for sale in violation of this chapter.

A. 
Residential. The owner or resident of any property used for residential purposes may offer for sale not more than one motor vehicle on the owner's or resident's property. Under no circumstances may the motor vehicle being offered for sale be located within any public right-of-way.
B. 
Commercial. The owner or lessee of any property used for commercial purposes, in accordance with the zoning ordinances of the Township of Lacey, may offer for sale not more than one motor vehicle at any one time on the commercial property.[1] Ownership of the motor vehicle offered for sale is limited to the property owner, lessee, or employee of the commercial business on the subject property. The motor vehicle can only be displayed for sale during the hours of 8:00 a.m. to 9:00 p.m. Under no circumstances may the motor vehicle offered for sale be located within any public right-of-way.

Any person, firm or corporation who or which violates any provision of this chapter shall, upon conviction, be fined not more than $1,000, be imprisoned for not more than 90 days and or serve a period of community service not exceeding 90 days. Each day on which a violation of any provision of this chapter occurs or is repeated shall constitute a separate offense. The Municipal Court of the Township of Lacey shall have jurisdiction to enforce the provisions of this chapter.
The violation of any provision of this chapter shall be subject to abatement summarily by a restraining order or injunction issued by a court of competent jurisdiction.
