[Adopted as Ch. 42 of the 1972 Code]
This article shall be known as "Town Ordinance No. 25."
No person shall use or employ self-contained underwater breathing apparatus nor any other apparatus or equipment designed for the purpose of enabling a person to stay under water (commonly known as "frogman" or "skin-diving" equipment) in any of the waters of the Town of Carmel, except in accordance with the provisions hereof. This article shall not be deemed to prohibit such use in cases of emergency when such use is requested by or required by municipal authorities or Police or Fire Departments of the Town of Carmel.
In Lake Mahopac, the use of such equipment mentioned in § 55-23 hereof shall not be permitted inside the area bounded by a line running from the extreme northerly end of Mahopac Point easterly to the east shore of Lake Mahopac.
A. 
Any person using the equipment mentioned in § 55-23 hereof shall at all times be accompanied by a boat with a person of 13 years or over in attendance.
B. 
The use of such equipment shall be permitted during daylight hours only.
A. 
All boats attending any person using the equipment mentioned in § 55-23 hereof shall display the recognized skin diver or frogman emblem of sufficient size to serve as a warning to other boats in the area.
B. 
No other boat shall knowingly operate within a radius of 200 feet of the boat attending any person or persons using the equipment mentioned in § 55-23 hereof.
Any property found by any person or persons using the equipment mentioned in § 55-23 hereof shall be turned over to the Police Department of the Town of Carmel for disposition according to law.
Any person or persons intending to use the equipment in § 55-23 hereof shall notify the Police Department of the Town of Carmel of the time and place of such use.
Violation of any of the provisions of this article shall be deemed an offense and shall be punishable by a fine not to exceed $250 or a term of imprisonment not to exceed 15 days, or both.
