Whenever the Mayor or his designee finds that an accumulation of snow
and/or ice makes it necessary in order to facilitate motor vehicle travel
or to expedite snowplowing, snow removal, sanding and other purposes, he or
his designee may declare a snow emergency and, after such declaration, implement
the rules as hereinafter set forth.
Whenever the Mayor or his designee declares a snow emergency, the following
rules shall apply:
A.
Parking regulations shall remain in effect unless specifically
posted otherwise.
B.
Parking on both sides of any street is prohibited.
C.
The snow emergency parking restrictions on all City streets
shall start at either 8:00 a.m. or 8:00 p.m., at which time vehicles shall
be parked on the required numbered side of the street. In the event that a
street shall not be designated as an odd- or even-numbered street, it shall
be required that vehicles be parked on the required odd or even side of the
street at the start of the snow emergency. After 48 hours have elapsed from
the initial designated time, the snow emergency shall terminate unless conditions
require an extension.
D.
The Mayor or his designee may restrict driving on all
or designated portions of City streets.
E.
The Mayor or his designee shall notify local radio and
local newspapers that a snow emergency has been declared and that snow emergency
rules are to be in effect and request them to notify the public of the parking
and driving restrictions.
F.
The Mayor or his designee shall direct the Hudson Police
and/or Columbia County Fire Control to sound the fire horns using the number
"45" to signify the start of the declaration of the snow emergency.
The City may restrict parking on designated streets and areas for special
snow removal purposes. Emergency signs shall be posted.
Whenever a motor vehicle becomes unable to be moved for any reason,
whether or not in violation of this chapter, on any part of a street on which
there is a covering of snow, sleet or ice or on which there is a parking restriction
in effect, the person operating such vehicle and the owner of the same shall
take immediate action to have the vehicle towed or pushed off the roadway
into the first available legal parking space. No person shall abandon or leave
his vehicle in the roadway for any period of time (regardless of whether they
have indicated, by raising the hood or otherwise, that the vehicle is stalled),
except for the purpose of securing immediate assistance during the actual
time necessary to go to a nearby telephone or to a nearby garage, gasoline
station or other place of assistance and return without delay. Such period
shall never exceed 15 minutes.
Any provision of this chapter which becomes effective by declaration
of the Mayor or his designee, while temporarily in effect, takes precedence
over other conflicting provisions of law normally in effect, except that it
shall not take precedence over provisions of law relating to the following:
A.
Alternate street parking regulations shall remain in
effect during a snow emergency unless otherwise specifically posted.
B.
Parking at fire hydrants, crosswalks, in front of driveways,
turning lanes, handicapped spaces or other specifically regulated spaces is
never permissible. Vehicles parked at these locations may be ticketed and
towed.
