The following words, when used in this article,
shall have the meanings ascribed to them in this section, except in
those instances where the context clearly indicates otherwise:
Every individual who shall operate a vehicle as the owner
thereof or as the agent, employee or permittee of the owner, or who
is in actual physical control of a vehicle.
The stopping of a motor vehicle upon any public highway and
leaving such motor vehicle unattended by a person capable of operating
it, for a period longer than is necessary to load or unload passengers
or freight.
Every natural person, firm, copartnership, association or
corporation.
Any public street, avenue, road, boulevard, highway or other
public place located in the City of Hudson, New York, and established
for the use of vehicles.
Any device in, upon or by which any person or property is
or may be transported upon a highway, except a device which is operated
upon rails or tracks.
It is hereby declared to be the purpose of the
City of Hudson, New York, to use parking meters as a means, but not
as an exclusive means, for governing or restricting the parking or
standing of vehicles in the streets and public places of the City
for the convenience, safety and accommodation of the public and the
relieving of traffic congestion.
Parking meter zones are established on the streets in the City of Hudson, New York, as set forth in Schedule A, entitled "Streets Included in Metered Area," hereto attached and made part hereof[1], limiting the time of parking or standing as therein prescribed.

In addition to the streets set forth in Schedule A,[1] power is hereby delegated to the Commissioner of Police, by official order, rule or regulation, to establish such other parking meter zones on the streets in the City of Hudson as he in his discretion may deem necessary. Wherever in other sections of this Article V the words "§ 305-15" now are used, such words shall be deemed to have added thereto and to include "§ 305-16."

Parking meters installed in the parking meter zones established as provided in § 305-15 hereof shall be placed upon the sidewalk or curb immediately adjacent to the individual parking places hereinafter described. Each parking meter shall indicate by a proper legend the legal parking or standing time established by the City, and when operated shall indicate on and by its face a signal for the duration of the period of legal parking or standing, and on the expiration of such period of legal parking or standing shall indicate illegal parking or standing by a signal on its face.
Where lines or markings are painted or placed
upon the curb, sidewalk and/or upon the streets adjacent to each parking
meter for the purpose of designating the parking space for which said
meter is to be used, each vehicle parked or standing adjacent or next
to any parking meter shall park or stand within the lines or markings
so placed. It shall be unlawful and a violation of this article to
park or stand any vehicle across such line or marking or to park or
stand said vehicle in such position that the same shall not be entirely
within the area so designated by such lines or markings.
When a parking space in any parking meter zone
is diagonal to the curb or sidewalk, any vehicle parked or standing
in such parking space shall be parked or shall stand with the foremost
part of such vehicle nearest to such meter.
A.
When any vehicle shall occupy any space adjacent to which a parking meter is located in accordance with the provisions of this article, the operator shall, upon entering said parking space, immediately deposit or cause to be deposited in such parking meter coins of the United States for a one-hour parking period or coins of the United States for a two-hour parking period, as such time period is prescribed by this article and as indicated upon the metal plates to be affixed to each meter, at rates as established by the Common Council and failure to deposit such coins as hereinbefore prescribed shall constitute a breach of this article and shall subject such person to the penalty prescribed in § 305-43E hereof. Upon the deposit of such coins as hereinbefore prescribed and placing said meter in operation, the parking space may be lawfully occupied by such vehicle during the period of time prescribed hereinbefore in § 305-15. If said vehicle shall occupy such parking space beyond the period so prescribed, the parking meter shall, by a signal on its face, indicate such illegal parking or standing, and in that event such vehicle shall be considered as parked or standing overtime and beyond the period of legal parking or standing time in any such part of a street where any such parking meter is located, and the operator thereof shall be in violation of this article and punishable as hereinafter set forth.

B.
No vehicle, other than a commercial vehicle as herein
provided, shall occupy the same parking meter space or area continuously
for a period of time in excess of two hours except in the municipal
parking lots as hereinafter provided.
C.
Parking meters in the areas and zones in and upon
the streets, avenues and thoroughfares herein designated as parking
meter zones and areas shall be in use and operation as follows: Monday
through Saturday of each week, beginning at 9:00 a.m. to the hour
of 5:00 p.m. On Sundays, January 1, Memorial Day, July 4, Labor Day,
Thanksgiving and Christmas Day, such parking meters in the areas herein
defined shall not be in operation and the provisions of this article
shall have no application.

D.
Commercial vehicles may occupy such parking meter
space for a reasonable length of time for the purpose of being loaded
and unloaded, when actually so engaged, without the deposit of such
coins as hereinbefore prescribed in the parking meter. Commercial
vehicles parked or standing in such parking meter areas and not engaged
in actually being loaded or unloaded shall require the deposit of
such coins as hereinbefore prescribed in the same manner as other
vehicles.

It shall be unlawful and a violation of the
provisions of this article for any person or operator to cause, allow,
permit or suffer any vehicle registered in the name of or operated
by such person to be parked or to stand overtime or beyond the period
of legal parking or standing time established for any parking meter
zone as herein described.
It shall be unlawful and a violation of the
provisions of this article for any person to deposit or cause to be
deposited in a parking meter a coin for the purpose of increasing
or extending the parking or standing time of any vehicle beyond the
period hereinbefore prescribed.
It shall be unlawful and a violation of the
provisions of this article to deposit or cause to be deposited in
any parking meter any slug, device or metallic substitutes for legal
coins of the United States.
It shall be unlawful and a violation of the
provisions of this article for any person to deface, injure, tamper
with, open or willfully break, destroy or impair the usefulness of
any parking meter installed under the provisions of this article.

A.
It shall be the duty of the police officers and parking
enforcement officers of the City of Hudson, New York, acting in accordance
with instructions issued by the Chief of Police, to issue and file
with the City Court a simplified traffic information with regard to
any vehicle that is or has been parked or is standing in violation
of any of the provisions of this article.
B.
Each such police officer or parking enforcement officer
shall also place on such vehicle a notice to the owner or operator
thereof that such vehicle has been parked or has been standing in
violation of the provisions of this article and an appearance ticket
requiring such owner or operator to appear in City Court with respect
to such violation upon a date and time therein specified.
Whenever any vehicle shall be found parked or standing overtime in any parking meter space or shall be found parked or standing therein in violation of any of the provisions of this article, such vehicle may be removed as provided in § 305-38 hereof.
In any prosecution or proceeding hereunder,
the registration plate displayed on a motor vehicle shall constitute
in evidence a prima facie presumption that the owner of such vehicle
was the person who parked or stood such vehicle at the place where
such violation occurred.
The provisions of this article may be temporarily
suspended by the Commissioner of Police, and he may prescribe such
temporary rules and regulations as traffic conditions may require
from time to time.
The Commissioner of Police may provide free
parking or standing space for the use of funeral vehicles, taxicabs,
buses, doctors' and nurses' vehicles, ambulances, municipal vehicles,
loading and unloading trucks and matters of a similar nature.
The coins required to be deposited in parking
meters as provided herein are hereby levied and assessed as fees to
provide for the proper regulation and control of traffic upon the
public streets and also the cost of supervising and regulating the
parking or standing of vehicles in the parking meter zones created
hereby and to cover the cost of the purchase, supervision, protection,
inspection, installation, operation, maintenance, control and use
of the parking meters described herein.
On such street or streets where parking meters
are installed, the provisions of this article shall supersede, during
the hours when such parking meters are in use, any of the other provisions
of any article relating to parking or standing of vehicles or traffic
upon public streets and property of the City of Hudson, New York.

There shall be metered parking in the municipal
parking lot on the south side of Columbia Street, between Fifth and
Sixth Streets, with parking charges at the rates as established by
the Common Council.
It shall be unlawful and a violation of this
article to park any vehicle in a municipal parking lot in any location
other than a space designated for parking.

A.
The City
Clerk is authorized and directed to make available annual parking
permits to be issued as of January 1 of each year hereafter. The annual
parking permit shall allow the vehicle in which such annual parking
permit is prominently displayed to be parked in any municipal parking
lot without parking meter payments, for the annual fee as established
by the Common Council; provided, however, that no vehicle 84 inches
or more in width and more than 84 inches in height or more than 20
feet in length may use such annual parking permit. No refunds for
lost or stolen permits are available.
B.
It shall
be unlawful and a violation of the provisions of this article for
any person to:
(1)
Deface,
tamper with or destroy any annual parking permit issued pursuant to
this article;
(2)
Reproduce
or counterfeit for purposes of avoiding compliance with the provisions
of this article any annual parking permit issued pursuant to this
article;
(3)
Use
any annual parking permit issued pursuant to this article without
the permission of such annual parking permit holder.
C.
Notwithstanding any other provision of this chapter, the fine for any violation of this section shall be equal to three times the annual fee established by the Common Council pursuant to this section in addition to any other fine permitted or required pursuant to this chapter or any other provision of applicable law. A finding after due process that a person has violated Subsection B(2) of this section shall be prima facie evidence of intent to defraud the City.

B.
Tradesman's permits shall be for seven consecutive
days or annually. The permit holder shall be permitted to park one
vehicle adjacent to a parking meter or in an alley immediately adjacent
to the work site without obstructing traffic flow in said alley. The
permit holder must be actively engaged in a trade, business or not-for-profit
business enterprise or activity while such permit is exhibited and
the vehicle parked in accordance with such permit. A tradesman's permit
shall be used only for construction and remodeling activities in the
City. The annual permit shall commence as of January 1 of each year.
The card permit shall be placed prominently in the front windshield
while the vehicle is parked pursuant to the permit.
C.
A merchant's permit shall allow the permit holder
to reserve and use one or two adjoining metered spaces for a twenty-four-hour
period in the vicinity of the permit holder's business. No business
or location will be issued more than 20 such permits in a year. The
permit holder must be actively engaged in a trade, business or not-for-profit
business enterprise or activity while such permit is exhibited and
the spaces used in accordance with such permit.
D.
No tradesman's or merchant's permits may be used in
spaces reserved for the handicapped.
