As used in this chapter, the following terms shall have the meanings indicated:
COMMERCIAL LITERATURE
Any printed or written matter, any sample or device, circular, leaflet, pamphlet, paper booklet, or any other printed or otherwise reproduced original or copies of any nature of literature:
A.ย 
Which advertises for sale any merchandise, product, commodity or thing.
B.ย 
Which directs attention to any business or mercantile or commercial establishment or other activity for the purpose of either directly or indirectly promoting the interest thereof by sales.
C.ย 
Which directs attention to or advertises any meeting, theatrical performance, exhibition or event of any kind for which an admission fee is charged for the purpose of private gain or profit.
D.ย 
Which while containing reading matter other than advertising matter is predominantly and essentially an advertisement and is distributed or circulated for advertising purposes.
NONCOMMERCIAL LITERATURE
Any printed or written matter, including but not limited to a sample, device, circular, leaflet, pamphlet, paper or booklet as well as any other printed or otherwise reproduced original or copy of the types of written material listed above:
A.ย 
Including but not limited to advertisements or promotions for a charitable organization, as defined in ยงย 296-2.
B.ย 
Including all items of printed or written matter not included in the definition above of "commercial literature."
Advertisements, handbills, circulars and papers may be distributed in the Township only if they are so securely placed at each dwelling that they will not be blown away by the wind; otherwise no person shall place any advertisement, handbill, circular or paper on or in any public street, sidewalk, building or vehicle within the Township.

No person shall throw or deposit any handbill in or upon any sidewalk, street or other public place within the Township; provided, however, that it shall not be unlawful on any sidewalk, street or other public place within the Township for any person to hand out or distribute without charge to the receiver any handbill to any person willing to accept it.
No person shall throw or deposit any commercial or noncommercial handbill in or upon any vehicle; provided, however, that it shall not be unlawful in any public place for a person to hand out or distribute without charge to the receiver thereof, a noncommercial handbill to any occupant of a vehicle who is willing to accept it.
No person shall throw or deposit any commercial or noncommercial handbill in or upon any private premises which are temporary or continuously uninhabited or vacant.
No person shall throw, deposit or distribute any commercial or noncommercial handbill upon any private premises if requested by anyone thereon not to do so or if there is placed on the premises in a conspicuous position near the entrance a sign bearing the words: "No Trespassing," "No Peddlers or Agents," "No Advertisement," or any similar notice, indicating in any manner that the occupants of the premises do not desire to be molested or have their right of privacy disturbed, or to have any handbills left upon the premises.
No person shall throw, deposit or distribute any commercial or noncommercial handbill in or upon private premises which are inhabited, except by handling or transmitting the handbill directly to the owner, occupant or other person then present; provided, however, that in the case of inhabited private premises which are not posted, as provided in this section, the person, unless requested by anyone upon the premises not to do so, shall have the authority to place or deposit the handbill in or upon the inhabited private premises, if the handbill is so placed or deposited as to secure or prevent it from being blown or drifted about the premises or sidewalks, streets, or other public places. Mailboxes may not be used when prohibited by federal postal law or regulations.
The provisions of this chapter shall not apply to the distribution of mail by the United States nor to newspapers.

Any person who intends to distribute commercial handbills at inhabited private residences pursuant to ยงย 195-7 shall be subject to the licensing requirements of Chapter 296, Peddling and Soliciting. No person shall distribute commercial handbills at inhabited private residences unless licensed in accordance with Chapter 296.

This chapter shall be enforced by the Police Department of the Township of Parsippany-Troy Hills.
