No person shall, regardless of intent, engage, or be permitted to engage, in the collection or disposal of solid waste in excess of 0.148 cubic yards of solids or 30 United States gallons of liquids, whether for profit or otherwise, except at a disposal site or any other place which has authorization from the Department of Environmental Protection or the Board of Public Utilities to accept solid waste.
No person shall, regardless of intent, transport or cause or permit to be transported any solid waste in excess of 0.148 cubic yards of solids or 30 United States gallons of liquids, whether for profit or otherwise, to a disposal site or any other place which does not have authorization from the Department of Environmental Protection or the Board of Public Utilities to accept solid waste.
Any person convicted of a violation of this article, i.e., of P.L. 1989, c. 118, is subject to a fine of not less than $2,500 for a first offense, not more than $5,000 for a second offense and not more than $10,000 for a third and every subsequent offense. Each day during which the violation continues constitutes an additional, separate and distinct offense.
If a person is convicted of a violation of the provisions of this article, the court shall, in addition to the penalties provided under § 354-30 of this article, require the person to perform community service for a term of not more than 90 days, and the person shall forthwith forfeit his right to operate a motor vehicle over the highways of this state for a period of not less than six months nor more than one year.
This article shall be enforceable by any member of the Police Department or the Director of Public Works or his designee or the Health Officer or his designee. In issuing a summons in connection with violations under this article shall cite P.L. 1989, c. 118 and this article.
The Township Council of the Township of Parsippany-Troy Hills reserves the right to award a reward of $250 or 10% of the fines collected by the Township of Parsippany-Troy Hills relative to violations occurring under P.L. 1989, c. 118 and/or this article to anyone who provides information that leads to the apprehension and/or conviction of a violator.
