A.
Words and phrases. Whenever any word and phrases are
used in this chapter, the meaning respectively ascribed to them in
Subtitle 1 of Title 39 of the Revised Statutes of the State of New
Jersey shall be deemed to apply to such words and phrases used herein.
B.
Official time standard. Whenever certain hours are
named in this chapter, they shall mean either Eastern standard time
or Eastern daylight saving time as may be in current use in the Township.
A.
The Chief of Police of the Township of Parsippany-Troy
Hills is hereby authorized to provide by regulation for the closing
of any street or portion thereof to motor vehicle traffic on any day
or days whenever he finds that such closing is necessary for the preservation
of the public safety, health or welfare.
B.
Any regulations promulgated by the Chief of Police and in accordance with Subsection A above shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
C.
Any violation of this regulation promulgated shall
be punished by a fine of not less than $250.
D.
Any regulation adopted that mandates the closing of
any street for a period greater than 48 consecutive hours shall not
become effective unless and until it has been submitted to and approved
by the Commissioner of the Department of Transportation.
Any vehicle parked in violation of this chapter
shall be deemed a nuisance and a menace to the safe and proper regulation
of traffic, and any peace officer may provide for the removal of such
vehicle. The owner shall bear the reasonable costs of removal and
storage which may result from such removal before regaining possession
of the vehicle.
Unless another penalty is expressly provided by New Jersey statute, every person convicted of a violation of a provision of this chapter or any supplement thereto shall be subject to the penalty set forth in § 1-17.
A.
The owner or other person in control or possession
of a property upon which a motor vehicle is parked or left unattended
or those having police powers may remove or hire others to remove
and store the vehicles which are illegally parked in fire zones.[1]
B.
It shall be the obligation of the owner of the vehicle
to pay the reasonable costs for the removal and for any storage which
may result from such removal before he shall be entitled to recover
the possession of the vehicle. If the owner of the vehicle refuses
to pay such costs, or fails to make any claim for the return of the
vehicle within 90 days after such removal, the vehicle may be sold
at public auction by first giving notice of the sale by publication
for two weeks, at least once in each week, in a newspaper circulating
in the Township, and at least five days' notice of such a sale shall
be given by posting the notice in five public places in the Township.
C.
The proceeds of the sale shall be applied to the cost
of towing and the expenses of the sale. The balance, if any, shall
be paid to the owner of the motor vehicle. The balance, if not claimed
by the owner within 60 days after the sale, shall be paid to the Township.
If any part or parts of this chapter are, for
any reason, held to be invalid, such decision shall not affect the
validity of the remaining portions of this chapter.
All former traffic ordinances of the Township
of Parsippany-Troy Hills are hereby repealed, and all ordinances or
parts of ordinances in conflict with or inconsistent with the provisions
of this chapter are hereby repealed, except that this repeal shall
not affect or prevent the prosecution or punishment of any person
for any act done or committed in violation of any ordinance hereby
repealed prior to the taking effect of this chapter.
A.
Traffic controls for street and highway construction
and maintenance operations. The Township of Parsippany-Troy Hills
finds and declares that problems of traffic control occur when traffic
must be moved through or around street construction, maintenance operations
and utility work, above or below the ground, which requires blocking
the street and obstructing the normal flow of traffic; and that such
obstructions are or can become dangerous when not properly controlled.
In order to better promote the public health, safety, peace and welfare,
it is necessary to establish controls and regulations directed to
the safe and expeditious movement of traffic through and around construction
and maintenance zones and to provide safety for the work forces performing
these operations.
B.
Adoption of the Manual on Uniform Traffic Control
Devices for Streets and Highways. The Township of Parsippany-Troy
Hills in the County of Morris, State of New Jersey, does hereby adopt
the current Manual on Uniform Traffic Control Devices for Streets
and Highways, hereafter known as the "MUTCD," except as hereby supplemented
and amended, as it controls and regulates whenever construction, maintenance
operations or utility work obstructs the normal flow of traffic. Any
person, contractor or utility that fails to comply with the provisions
of the MUTCD while performing such work is in violation of this section.
C.
Required hiring of off-duty full-time police officers
as traffic directors.

(1)
Any
construction on or within, or maintenance to, any Township roadway,
such construction or maintenance, including but not limited to roadway
excavation, requiring the detour of traffic into a lane not otherwise
designated for such traffic, or requiring the closure of the roadway,
shall require the hiring of a minimum of one off-duty, full-time police
officer.
(2)
Any work conducted on, under or above any Township heavily traveled roadway, as defined in Subsection E below, or any work adjacent to a Township heavily traveled roadway, which will obstruct, interfere with and/or detour traffic on the roadway, shall require the hiring of a minimum of one off-duty, full-time police officer.
(3)
It shall
be the responsibility of any person, firm or corporation, including
any public utility as required under the public utility agreement,
N.J.A.C. 16:25-9.2, wishing to conduct work on, under or above the
roadway or any work adjacent to the roadway that will obstruct, interfere
with and/or detour traffic on the roadway to contact the Traffic Section
of the Police Department prior to the start of any such work in order
to arrange a preconstruction meeting for the submission of plans for
the safe movement of traffic during such periods of construction of
work.
(4)
The
preconstruction meeting must occur three or more working days prior
to the planned construction or work. "Working days" shall be any day
the Township Clerk's office is open. These preconstruction meetings
shall be arranged with the Traffic Section of the Police Department.
(5)
Such
plans, including the proposed number of off-duty, full-time police
officers to be hired pursuant to this section, shall require approval
by the Traffic Section of the Police Department. This requirement
shall be in addition to any other permit or other approval required
by any other federal, state or municipal law, ordinance or regulation.
(6)
The
occurrence of a preconstruction meeting as described above shall not
relieve the person, firm or corporation, including a public utility,
planning construction or work upon or near a roadway within the Township
of its duty to fully comply with any other requirements, terms or
preconditions established by the Township in reference to proposed
construction or work upon or adjacent to roadways within the Township.
(7)
Any
person or entity failing to submit and secure approval for its traffic
control plans prior to the start of such work shall be deemed to be
in violation of this subsection.
(8)
The requirements of Subsection C herein shall not apply to any construction on or within, or maintenance to, any Township roadway, or any work conducted on, under or above any Township heavily traveled roadway when such construction, maintenance, or work is performed by the Township or its designated agents and a traffic management plan for such construction has been approved by the Traffic Section of the Police Department.
D.
Emergency contact telephone numbers. The person, contractor
or utility shall provide at least two emergency contact telephone
numbers to be called in case of emergency problems at the construction
or maintenance site prior to the start of any work. If, for any reason,
emergency contact cannot be made, or if the emergency contact person
does not respond to a call from the Police Department to correct such
hazardous condition, the Township of Parsippany-Troy Hills may respond
to correct the hazardous condition(s). The reasonable fees for such
emergency services by the Township of Parsippany-Troy Hills shall
be charged to the person, contractor or utility responsible for the
condition.
E.
Heavily traveled roadways. The Police Department of
the Township of Parsippany-Troy Hills shall maintain a list of all
roads that are determined to be "heavily traveled," based on existing
patterns of traffic flow for the purposes of this chapter. Such list
may be updated from time to time by the Traffic Section of the Police
Department as conditions warrant and shall be available for inspection
and copying during normal business hours.
F.
Hours. There shall be no construction, maintenance
operations or utility work on any roadway listed on the current heavily
traveled roadway list in the Township before the hour of 9:00 a.m.
or after 4:00 p.m. The Chief of Police or his designee may adjust
this time limit to permit work prior to 9:00 a.m. or after 4:00 p.m.
If the officer in charge determines that the construction or maintenance
operations prior to 9:00 a.m. or after 4:00 p.m. would substantially
delay traffic or cause a safety or health hazard, the work shall then
be permitted only between 9:00 a.m. or after 4:00 p.m. On all other
streets, hours of operation shall be from 7:30 a.m. to 7:00 p.m.
G.
Road closing. Road closing and/or traffic detours
shall not be permitted unless approved by the Township Police Department.
H.
Traffic directors. Traffic directors shall be posted
at all construction or maintenance sites when determined by the Township
Police Department that same is necessary to provide for the safe and
expeditious movement of traffic.
I.
Stop work. The Township Police Department shall have
the authority to stop work, including the removal of equipment and
vehicles, stored material within the street right-of-way, backfilling
of open excavations and/or related work, in order to abate any nuisance
and/or safety hazard or for any violation of this section.
J.
Emergency repair work.
(1)
In the case of emergency repair work where emergency
construction, maintenance operations or utility work must be performed
that will obstruct, interfere or detour traffic on any roadway in
the Township, the person, contractor or utility performing such operations
shall notify the Police Department of Parsippany-Troy Hills of such
emergency operation and shall disclose the nature of the emergency,
location and hours of operation.
(2)
All emergency repair operations shall be performed
with full regard to safety and to keep traffic interference to an
absolute minimum. There shall be compliance with the provisions of
the Manual on Uniform Traffic Control Devices during all emergency
repair operations.
K.
Site preparation. It is to be expressly understood
that no materials, vehicles or equipment are to be placed in the roadway
or sidewalk until all construction signs, light devices and pavement
markings are installed and approved.
L.
Violations and penalties. Unless another penalty is
provided by New Jersey statute, every person convicted of a violation
of a provision of this section or any supplement thereto shall be
subject to a fine of not less than $250. A separate offense shall
be deemed committed on each day during or on which a violation occurs
or continues.
M.
Police Department to notify all affected agencies.
The Township Police Department shall have sole responsibility to notify
immediately all affected agencies, including but not limited to fire
districts, ambulance, rescue and recovery, hazardous materials and
the school transportation office, of any work or construction upon
or near a roadway within the Township which would delay or interfere
with the providing of services. Such notification shall be made in
a manner pursuant to and in compliance with the Township Police Department's
Policy and Procedures, specifically Vol. IX, Chapter 3 entitled "Construction
Site Traffic Control."
A.
Regulations not exclusive. The provisions of this
chapter imposing a time limit on parking shall not relieve any person
of the duty to observe other, more restrictive provisions prohibiting
or limiting the stopping or standing or parking of vehicles as set
forth in N.J.S.A. 39:4-138, any other New Jersey statute or as hereinafter
provided.
A.
Upon the declaration of an emergency, there shall
be no parking upon the streets where temporary EMERGENCY NO PARKING
signs are displayed. The Chief of Police or, in his absence, the ranking
police officer, is authorized to declare an emergency and to direct
the posting of EMERGENCY NO PARKING signs when weather conditions,
accidents, road construction, fire or public celebrations dictate
or require avoidance of hazards or other conditions which interfere
with the free flow of traffic. Notification that EMERGENCY NO PARKING
signs are being or will be posted shall be given to the operator or
owner of any vehicle which has been parked prior to the posting of
the signs.
B.
Any unoccupied vehicle parked or standing in violation
of this section shall be deemed a nuisance and a menace to the safe
and proper regulation of traffic, and any police officer may provide
for the removal of such vehicle. The owner shall pay the reasonable
costs of removal and storage which may result from such removal before
regaining possession of the vehicle.
C.
The effectiveness of this subsection is contingent
upon the signs being erected as required by law.
A.
Prohibition.
(1)
Whenever snow has fallen and the accumulation is such
that it covers the streets and highways, an emergency shall exist
and no vehicle shall be parked on any street or highway or portions
thereof.
(2)
The above parking prohibitions shall remain in effect
until after the snow has ceased and the streets have been plowed sufficiently
and to the extent that parking will not interfere with the normal
flow of traffic.
B.
Any unoccupied vehicle parked or standing in violation
shall be deemed a nuisance and a menace to the safe and proper regulation
of traffic, and any police officer may provide for the removal of
such vehicle. The owner shall pay the reasonable costs of the removal
and storage which may result from such removal before regaining possession
of the vehicle.
C.
The effectiveness of this section is contingent upon
erection and maintenance of signs at all street, road or highway entrances
for motor vehicles into the Township of Parsippany-Troy Hills in accordance
with N.J.S.A. 39:4-198.
No person shall stop or stand a vehicle between
the hours specified on any day upon any of the streets or parts of
streets described.

Signs, pavement markings, installation and maintenance. The owners of the premises referred to in § 405-35C shall provide and install signs and pavement markings for each parking space reserved for the use of handicapped persons, which signs and markings shall be in accordance with the Manual on Uniform Traffic Control Devices. The cost of procurement and installation of the signs and pavement markings shall be the responsibility of the owner of said property. The owner shall subsequent to initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Township of Parsippany-Troy Hills. The owner shall, be responsible for the repair and restoration of same.
A.
Regulation for the movement and the parking of traffic
on municipal property and Board of Education property. In accordance

General parking.
[i]
No person shall park or caused
to be parked any vehicles in the aisle area adjacent to the Parsippany
Branch of the Free Public Library. The area is designated as "No Parking
on Both Sides," as shown on the plan on file at the Office of the
Township Clerk.
[ii]
No person shall park or cause
to be parked any vehicle or vehicles in the Parsippany branch parking
lot on Halsey Road or in the Lake Hiawatha Branch parking area, adjacent
to the library on Hiawatha Boulevard, at any time except for library
business. Any vehicle found to be in violation of this subsection
shall be towed at the owner’s expense.
[b]
Handicap parking. All stalls shall
be according to ADA standards and will be signed with R7-8 and R7-8P
(reserved parking sign and penalty plate, respectively), in the designated
parking areas for persons who have been issued the handicap parking

Regulations.
[a]

section shall be cause to tow noncompliant vehicle at owner’s
expense.
[b]
No person shall park or cause to
be parked any vehicle or vehicles on the premises between the hours
of 1:00 a.m. and 4:00 a.m. Whenever snow has fallen and the accumulation
is such that it covers the streets and highways, an emergency shall
exist, and vehicles may be parked overnight until the streets have
been plowed sufficiently and to the extent that parking on the street
will not interfere with the normal flow of traffic.

Handicap parking. All stalls shall
be according to ADA standards as per site plan and will be signed
with R7-8 and R7-8P (reserved parking sign and penalty plate, respectively),
in the designated parking areas for persons who have been issued the
handicap parking permit by the Commission of Motor Vehicles.

are designated as commuter and park use only, as per the site plan:
no time limit; Lot 3, Lot 3A, Lot 4, Lot 4A, Lot 5 and 5A, as per
the site plan: three-hour parking limit from 8:00 a.m. to 1:00 p.m.,
Monday through Friday.
[d]
Tow-away zones. Any vehicle parked
or standing in violation of this subsection shall be deemed a nuisance
and such a menace to the safe and proper regulations of traffic, and
any police officer may provide for the removal of such vehicle. The
owner shall pay all reasonable costs of removal and storage which
may result from such removal before regaining possession of said vehicle.
(3)
Board of Education properties. In accordance with
the provisions of N.J.S.A. 39:4-197, the following Board of Education
properties shall have the movement of traffic controlled by the type
of regulation indicated. No person shall operate or park a vehicle
in violation of the regulations indicated.

Property: Parsippany High School (309 Baldwin
Road) and the Joseph Windish Administration Building (477 Vail Road).

to be parked, any vehicle or vehicles in the Board of Education Administration
building on Parsippany Road at any time, except for Board of Education
business. Any vehicle found to be in violation of this subsection
shall be towed at the vehicle owner’s expense.
(4)
Commuter lots. In accordance with the provisions of
N.J.S.A. 39:4-197, the following municipal property shall have the
movement of traffic controlled by the type of regulation indicated.
No person shall operate or park a vehicle in violation of the regulations
indicated.

Property: South Beverwyck and Route US 46 Commuter
Lot.

B.
Regulation for the movement and the parking of traffic
on private property open to the public and to which the public is
invited (retail business). In accordance with the provisions of N.J.S.A.
40:48-2.46, the following private property that is open to the public
and to which the public is invited, the movement of traffic shall
be controlled by the regulations listed herein. No person shall operate
or park a vehicle in violation of the following regulations.

Property: Green Hill Shopping Center/ Parsippany Road.
(a)

C.
Regulation for the movement and the parking of traffic
on all other private property. In accordance with the provisions of
N.J.S.A. 39:5A-1, the regulations of Subtitle 1, Title 39 of the Revised
Statutes are hereby made applicable to the properties listed below.

Property: Parsippany Troy Hills Fire District No.

(a)
Regulations.

specialty parking in this subsection, such as volunteer firefighters'
private vehicles, must be properly identified and the reserved parking

E.
Signs, pavement markings, installation and maintenance. The owners of the premises referred to in § 405-36B and C shall provide and install signs and pavement markings as required, which signage and markings shall be in accordance with the Manual on Uniform Traffic Control Devices. The cost for the procurement and installation of signs and pavement markings shall be the responsibility of the owner of said property. The owner shall, subsequent to initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Township of Parsippany-Troy Hills. The owner shall be responsible for the repair and restoration or replacement of same.

Low-speed vehicles, as defined in N.J.S.A. 39:1-1,
shall not be operated on any street within the Township, and it shall
be unlawful for any person to so operate a low-speed vehicle.
