As used in this chapter, the following terms shall have the meanings indicated:
SATELLITE TELEVISION ANTENNA
An antenna, the purpose of which is to receive television or radio signals from orbiting satellites. Said antenna is sometimes known as a "disc" or "dish."
A. 
For purposes of the Zoning Code of the Village of Pittsford, New York,[1] a satellite television antenna shall be in all respects considered an accessory structure and/or building and shall be subject to all Zoning Code setback restrictions.

B. 
No satellite television antenna shall be located or affixed to exceed eight feet in height from ground level.
All satellite television antennas shall be effectively screened on all sides by a solid fence, compact evergreen hedge, planting screen or principal structure. Prior to the issuance of a building permit, a plan for such screening shall be submitted by application to the Architectural Review Board, and that Board's approval must be obtained before a building permit will be issued. Satellite television antennas shall be located and designed to reduce visual impact from surrounding properties at street level and from public streets.
A. 
All antennas and the construction and installation thereof shall conform to applicable Electrical and Building Codes.[1]

B. 
Antennas shall meet all manufacturer specifications, be of noncombustible and corrosive resistant material and be erected in a secure, wind-resistant manner.
Every antenna must be adequately grounded for protection against a direct strike of lightning.
Antennas shall be located at ground level only.

No antenna shall be installed, erected or maintained until a building permit for the same shall have been issued by the Village Clerk or the Village Building Inspector, after an application therefor showing conformity with all the terms and provisions of this chapter.
Any person who violates any provision of this chapter shall, upon conviction thereof, be subject to a fine not exceeding $350 or imprisonment for a period not to exceed six months, or both, for conviction of a first offense; for conviction of a second offense, both of which were committed within a period of five years, subject to a fine not less than $350 nor more than $700 or imprisonment for a period not to exceed six months, or both; and, upon conviction for a third or subsequent offense, all of which were committed within a period of five years, subject to a fine not less than $700 nor more than $1,000 or imprisonment for a period not to exceed six months, or both. However, for the purpose of conferring jurisdiction upon courts and judicial officers generally, violations of this chapter shall be deemed misdemeanors, and, for such purpose only, all provisions of law relating to misdemeanors shall apply to such violations. Each week's continued violation shall constitute a separate additional violation.
