[HISTORY: Adopted by the Board of Trustees of the Village of Southampton 10-5-1962; amended in its entirety 4-28-1967. Amendments noted where applicable.]
It shall be unlawful to extend or cause to be extended, by digging, dredging or other earth-moving means or methods, any bay, lake, pond, creek or any arm of such natural body of water bordering on or situated upon any land in the Village of Southampton, so as to create any boat basin, lagoon, canal or similar extension of the natural limits of such body of water, by whatever designation called, which shall be more than 40 feet in length and/or more than 20 feet in width; but the removal of undesirable vegetation and the removal of bog for a distance of 10 feet at or near the shore of any such body of water or arm thereof shall not be deemed an extension of same. Removal of bog for a distance in excess of 10 feet may be permitted by the Board of Trustees in cases of special circumstances adversely affecting the health, safety and general welfare of the Village.
No part of any such permitted boat basin, lagoon or canal shall be nearer than 10 feet from any exterior boundary line, other than a boundary line formed by a natural body of water, of the property upon which same is located. Such permitted boat basin, lagoon or canal shall be bulkheaded in accordance with specifications to be submitted by the applicant for a bulkheading permit and approved by the Village Engineer. Upon the approval of same in writing by the Village Engineer, the Village Clerk shall issue a bulkheading permit. All such bulkheads shall be maintained in good repair.

Any person who violates this chapter or fails to comply with any of its requirements shall, upon conviction thereof, be subject to the penalties provided in Article II of Chapter 1 of the Code of the Village of Southampton.
