Any owner of real property who shall create a subdivision
or who shall subdivide real property into lots within the Village
of Southampton without first obtaining approval of the Planning Board
of the Village of Southampton of a subdivision map or plat showing
the land to be subdivided shall be guilty of a violation of this chapter.
Any contract vendee, agent or contractor of such owner who shall knowingly
participate in such violation and any grantee of such owner who shall
knowingly participate in such violation shall also be guilty of a
violation of this chapter. As used herein, the term "subdivision"
shall mean a subdivision as defined in the rules and regulations for
the subdivision of land in the Village of Southampton.[1]
B.Â
Where a violation of the rules and regulations for
the subdivision of land in the Village of Southampton, as heretofore
adopted and approved and from time to time hereafter amended,[2] Has been committed or shall exist, any contract vendee,
agent or contractor of such owner who shall knowingly participate
in such violation and any grantee of such owner who shall knowingly
participate in such violation shall be guilty of a violation of this
chapter.
C.Â
Where a violation of any provision or condition of
any resolution or approval of the Planning Board of the Village of
Southampton relating to a subdivision adopted or granted under the
authority of its rules and regulations or otherwise pursuant to law
has been committed or shall exist, the owner of the real property
where such violation has been committed or shall exist, any contract
vendee, agent or contractor of such owner who shall knowingly participate
in such violation and any grantee of such owner who shall knowingly
participate in such violation shall be guilty of a violation of this
chapter.
D.Â
Any person who shall perform physical work on real
property, including but not limited to the clearing of land, other
site preparation and construction of improvements, in violation of
the rules and regulations for the subdivision of land in the Village
of Southampton,[3] in violation of any provision or condition of any resolution
or approval of said Planning Board relating to subdivisions adopted
or granted under the authority of its rules and regulations or otherwise
pursuant to law shall be guilty of a violation of this chapter.
E.Â
The provisions of this chapter may be enforced by
any method or remedy provided by law. In addition to other remedies
provided by law, any appropriate action or proceeding may be instituted
to prevent, restrain, correct or abate any violation of this chapter.

A.Â
The following application fees shall be paid by applicants
for subdivision approval:

(1)Â
Sketch plan submission. The application fee shall
be $750, plus $200 for each proposed lot in the proposed subdivision.
(2)Â
Preliminary plat submission. The application fee shall
be $750, plus $200 for each proposed lot in the proposed subdivision.
(3)Â
Final plat submission.
(a)Â
In the case of a proposed subdivision which
does not involve new road construction, the application fee shall
be $750, plus $200 for each proposed lot in the proposed subdivision.
(b)Â
In the case of a proposed subdivision which
involves new road construction, the required review fee must be paid,
and there shall be no separate application fee for the final plat
submission.
B.Â
A review fee shall be paid by applicants for subdivision
approval for review of proposed subdivisions which involve new road
construction. The review fee shall be paid in two payments.
(1)Â
The review fee shall be 5% of the final estimated
total cost of capital improvements (performance bond estimate), excluding
water mains and underground electric lines.
(2)Â
At the time of the preliminary plat submission, a
fee equal to 1/2 of 5% of the preliminary estimated cost of capital
improvements shall be paid on account of the review fee. The basis
for the preliminary estimated cost of capital improvements shall be
a unit price per linear foot of road as shown on the preliminary plat;
such unit price shall be determined by the Planning Board.
(3)Â
The final payment shall be paid prior to the time
that the Chairman or Secretary of the Planning Board signs the final
plat. The final payment shall be 5% of said final estimate less the
fee previously paid on account of the review fee.
C.Â
An inspection fee shall be paid prior to each field inspection of improvements (see § 97-28) in an amount which will recover the actual cost of such field inspection.
D.Â
In the case of a resubdivision which involves a request for a waiver in accordance with § 97-45B (alteration of lot lines), the application fee to be paid at the time of the sketch plan submission shall be $200.
E.Â
The application, review and inspection fees may be
changed from time to time by resolution of the Village Board of Trustees.
