A. 
It shall be unlawful for any person to engage in skateboarding, roller-blading or ride upon or propel any skateboard, roller blades or scooters upon:
(1) 
Union Street from Spring Street to Ann Street.
(2) 
Any sidewalk along Union Street from Spring Street to Ann Street.
(3) 
Emaus Street from Catherine Street to Pine Street.
(4) 
Any sidewalk along Emaus Street from Catherine Street to Pine Street.
(5) 
Brown Street from Scott Avenue to Peony Avenue.
(6) 
Any sidewalk along Brown Street from Scott Avenue to Peony Avenue.
B. 
There shall be no placing of any type of skateboard, roller blade or scooter ramps on any street in the Borough of Middletown.
Neither the parent of any minor (person under the age of 18) nor the legal guardian of any minor shall authorize or knowingly permit any such minor to violate any of the provisions of this chapter.

Any person who shall violate any of the provisions of this chapter shall, upon conviction thereof:
A. 
For a first offense. The skateboard, roller blades or scooter used in violation of this chapter shall be impounded by the Police Department of the Borough for a period not exceeding 15 days. If the person violating the chapter is a minor, in addition to the confiscation of the skateboard, roller blades or scooter as aforementioned, the Borough police shall notify the parents, guardian or other person having legal custody of said minor of the violation of this chapter and the impounding of the skateboard, roller blades or scooter. In addition, said individual shall be provided with a copy of this chapter.
B. 
For a second or subsequent offense. The skateboard, roller blades or scooter of any person violating the provisions of this chapter for the second and/or subsequent time shall be impounded by the Police Department of the Borough for a period not exceeding 30 days, and said person shall, upon conviction, be sentenced to pay a fine of $15 and costs. In the event that said person is a minor, the skateboard, roller blades or scooter of said minor shall be impounded by the Police Department of the Borough for a period not exceeding 30 days, and the parent, guardian or other person having legal custody of said minor shall, upon conviction, be sentenced to pay a fine of $15 and costs.
