No person shall stop, stand or park a vehicle in any area designated
as a place for handicapped parking within the Town including, but not limited
to public streets, private drives or parking areas open to the public and
Town property or other public facilities, unless the vehicle bears a permit
issued pursuant to New York Vehicle and Traffic Law §§ 1203-a
or 404-a and such vehicle as being used for the transportation of a severely
disabled or handicapped person.
Any person, firm or corporation owning or operating an enterprise required
to maintain handicapped parking spaces pursuant to the New York State Vehicle
and Traffic Law, the Town Zoning Board of Appeals, the Town Planning Board,
Town law, rule or regulation or any other applicable law or authority shall
erect and maintain in good repair appropriate signs and other marking designating
the parking areas, and shall keep such areas free of obstructions.

Any person, firm or corporation violating the provisions
of this chapter shall be guilty of a violation punishable by a fine not less
than $250 nor more than $1,000.

In addition to enforcement by any peace officer or police
officer authorized under the laws of the State of New York, this article may
and shall be administered and enforced by the Code Enforcement Officer and
the Deputy Code Enforcement Officer of the Town of Van Buren.

The Code Enforcement Officer and the Deputy Code Enforcement
Officer of the Town of Van Buren are hereby authorized to issue and serve
appearance tickets with respect to violations of this article and to prepare
and file such other documents and take such actions in connection therewith
as may be required under the Criminal Procedure Law.
