This chapter shall be known and may be cited as the "Code Enforcement Law" of the Village of New Hyde Park.
There is hereby created and established a separate agency and department of the village, to be known as the "Code Enforcement Bureau." It shall be the function of said Bureau, its officers, agents and employees to carry out as part of their duties the enforcement of all local laws, codes, ordinances, rules and regulations of the village, as presently enacted or hereafter amended, codified or recodified by the Board of Trustees, and such statutes or general laws of the State of New York applicable within the village and capable of enforcement by village officials, other than police officers or peace officers, under applicable law through the issuance of appearance tickets pursuant to Article 150 of the Criminal Procedure Law and returnable in the Village Justice Court.
The Mayor, subject to the approval of the Board of Trustees, is hereby authorized to appoint to the Bureau such persons, including village officials and/or employees, as may be deemed necessary by the Board of Trustees for carrying out the provisions of the aforesaid section. The scope of duties, hours and days of employment, terms of office, compensation and other provisions of employment of any person or persons so appointed shall be established, from time to time, by resolution of the Board of Trustees, and every such appointee shall serve at the pleasure of the Board.
Unless otherwise provided by resolution of the Board of Trustees, officers and employees of said Enforcement Bureau shall have concurrent jurisdiction, in enforcing the provisions of any order, ordinance, local law, code, rule, regulation or statute, with the officer or employee generally prescribed by law as the ordinary enforcement officer of any such provision, including but not limited to the following officers and/or employees: Building Inspector, Plumbing Inspector, Zoning Inspector, Meter Enforcement Officer and Superintendent of Public Works.
No officer or employee of the Code Enforcement Bureau shall be deemed to be, nor shall be otherwise exercise any of the powers or duties of, a police officer or peace officer, as those terms are defined by law, but shall be a local code enforcement officer of the village with the authority and power solely to issue appearance tickets for violations of village laws, codes and other legislative enactments as provided for herein.
