This chapter shall be known and may be cited
as the "Building Construction Control Law of the Village of New Hyde
Park" or, in abbreviated form, as the "BCCL-NHP." This chapter revises
and continues, as part of the Code of the Village of New Hyde Park,
certain provisions of the Building Code of the Incorporated Village
of New Hyde Park not heretofore superseded by the provisions of the
New York State Uniform Fire Prevention and Building Code (the "Uniform
State Code") and, together with such Uniform State Code, presumptively
provides for all matters concerning, affecting or relating to the
construction, equipment, fire-protection equipment and systems, alteration,
repair and removal of or in buildings, structures and their accessory
improvements heretofore erected or installed or hereafter to be erected
or installed within the territorial boundaries of the Village of New
Hyde Park.
A.
Both the provisions of this chapter and the provisions
of the Uniform State Code (under Title 9 of the NYCRR) shall be fully
applicable within the Village of New Hyde Park, and all such provisions
shall be administered and enforced within the Village as authorized
and directed by or pursuant to Article 18 of the Executive Law of
the State of New York and as further authorized and directed by and
pursuant to the provisions of this chapter; and whenever the phrase
"in conformity with the provisions of this chapter" shall appear herein,
such phrase is used and intended to be construed as if followed immediately
by the words "and the provisions of the Uniform State Code," unless
the context clearly requires otherwise.
B.
Except as may be otherwise provided for by local law
or state or federal statute, no wall, structure, building or part
thereof and no equipment, fire-protection equipment and systems, fixtures,
components or other mechanical additions or accessory improvements
thereof or thereto shall hereafter be built or constructed or reconstructed,
installed or erected, altered or converted, renovated or repaired,
moved or removed or used or occupied within the Incorporated Village
of New Hyde Park, otherwise than fully in conformity with the provisions
of this chapter; and any violation of the foregoing requirement or
of any lawful order directing or requiring the remedying of the same
shall constitute an offense and shall be punishable in conformity
with the provisions of this chapter.
For the purposes of this chapter, all words,
terms and phrases appearing herein shall have the same meanings as
may be ascribed to them in and by § 372 of the Executive
Law of the State of New York and/or in and under the Uniform State
Code, unless the context shall clearly require a different interpretation.
