This chapter shall be known and may be cited as the "Plumbing Compliance
and Licensing Law of the Village of New Hyde Park" or, in abbreviated form,
as the "PCLL-NHP."
This chapter adopts or continues, as part of the Code of the Village of New Hyde Park (hereinafter, the "Village Code"), those updated provisions of the village's Plumbing Code (originally adopted by the Board of Trustees by ordinance of January 8, 1947) not otherwise superseded or rendered obsolete by the mandatory and peremptory provisions of the New York State Uniform Fire Prevention and Building Code (hereinafter, the "Uniform State Code") and/or Chapter 57 (entitled "Building Construction") of this Village Code. In conjunction with, and as a supplement to, both the aforesaid Uniform State Code and Chapter 57 of this Village Code, this chapter is intended to presumptively provide for all matters concerning, affecting or relating to the installation, alteration, addition, extension, relocation or removal of plumbing, drainage, sewerage and heating systems and their respective components, as well as the qualifications, licensing requirements and other regulatory controls pertaining to plumbers and other persons who may be authorized or required to perform any of the aforesaid work within the Village of New Hyde Park.

Whenever the same shall appear in this chapter, each
of the following words, terms or phrases shall have the meaning ascribed to
it under this subsection:
The Board established and empowered under the provisions of this
chapter to carry out certain prescribed duties and functions, especially the
testing and certification of master plumbers. When required by the context,
it shall also mean an equivalent counterpart body established by, and acting
for, any recognized reciprocating municipality.
That Department of the village established and empowered to act under and pursuant to the provisions of Article II of Chapter 57 of the Village Code, and any individual officer, employee or other duly designated agent thereof when acting within the scope of his/her official powers and duties on behalf of that Department.
The official written document, issued to a qualified individual by
the Board of Examining Plumbers, which certifies that such individual has
been tested and examined and found sufficiently knowledgeable, experienced,
fit and competent to carry on the business of the plumbing trade as an independent
or employing master plumber.
A person having some degree of training, skill and experience in
performing the work of the plumbing trade, but who has not yet qualified for,
nor acquired, both the official certificate of competency and the license
of a master plumber which are legally required by this chapter to independently
practice and carry on such trade.
A person officially certified as fit and competent and who is duly
licensed and qualified, in accordance with the requirements of this chapter,
to independently engage in the business and carry on the practice of the plumbing
trade.
The separate written document, issued by the village to a master
plumber certified and qualified in accordance with the requirements of this
chapter, which officially authorizes and entitles such plumber to independently
carry on and engage in the business of the plumbing trade within the territorial
jurisdiction of the village.
Any written intermunicipal agreement existing between the village
and any one or more other municipalities located within the State of New York
and which essentially requires that each of the signatory parties issue a
reciprocal master plumber's license to any qualified person who holds
an original certificate of competency and current license issued by any other
coparty to such agreement and who maintains his/her principal place of business
within the municipal boundaries of that other coparty.
Any village, city or town which, together with the village, is a
signatory coparty to a reciprocal licensing agreement as defined in this subsection.
The reciprocal licensing agreement originally made and executed by
the Towns of Hempstead, North Hempstead and Oyster Bay on or about September
15, 1969, and subsequently ratified and endorsed by the village and other
municipal coparties, as now or hereafter adopted in force and effect.
The New York State Uniform Fire Prevention and Building Code (under
Title 9 of the NYCRR[1]), effective on and after January 1, 1984, as currently enacted
or hereafter amended.

For the purposes of this chapter, any word, term or phrase, or any derivative or abbreviation thereof, appearing in this chapter, but not defined in Subsection A of this section or within the particular context of its usage within this chapter, shall have the meaning, if any, ascribed to it (in descending order of priority) under New York Executive Law § 372; the Uniform State Code; or Chapter 57, Building Construction, of this Village Code.
