This chapter shall be known and may be cited as the "Solid Waste Collection Law of the Incorporated Village of New Hyde Park."
A. 
The word "shall" is always mandatory and not merely directory. The word "may" is always discretionary and not mandatory.
B. 
For the purpose of this chapter, the following words, terms, phrases and their derivations shall have the meanings given herein:
ASHES
Includes all residue from the burning of wood, coal, coke or other combustible materials.
COLLECTION VEHICLE
Includes any vehicle so designed, built, converted or actually used for the purpose of collecting garbage and refuse.
COMMERCIAL AREA
Includes any area or zone where business enterprises and/or uses, other than industrial or manufacturing, are located or operating.
DPW
Refers to the Commissioner or Superintendent of the Department of Sanitation or any individuals designed or employed by either of them as their respective authorized representatives.
GARBAGE
Includes all putrescible animal and vegetable wastes resulting from the handling, preparation, cooking and consumption of food and such readily combustible materials as paper, cardboard, wood, excelsior, cloth, food containers, cans and bottles.
HOLIDAY
That day on which a holiday is officially designated, recognized or celebrated by the Board of Trustees as set forth in this chapter or by resolution of the Board.
LITTER
Garbage, refuse or rubbish as may be defined herein and other trash or waste material which is thrown or deposited and which tends to create a danger or nuisance to the public health, comfort, safety, convenience or welfare.
NEWSPAPERS
All papers sold or distributed at stated intervals, usually daily or weekly, to convey news, advocate opinions, contain advertisements and other matters of public interest, but excluding all books, magazines or other periodicals as well as other paper products of any nature or description whatsoever.
OPERATE
To pick up, collect, load or otherwise perform collection and transportation of refuse.
PRIVATE PROPERTY
Any real or personal property other than that used or operated as a public place or highway or otherwise owned, leased or operated by the village, another municipality, the State of New York, the United States or the agents of each or any of them.
REFUSE
Includes all putrescible and nonputrescible solid wastes (except human wastes or sewage), including garbage, ashes, rubbish and similar waste materials.
RESIDENTIAL AREA
An area primarily zoned and restricted to residential occupancy and uses.
RUBBISH
Includes all nonputrescible solid wastes (excluding ashes), consisting of both combustible and noncombustible wastes such as wood, stones, crockery, glass, metals, bedding and furniture, tin cans, magazines, yard clippings and similar materials.
SOLID WASTE
All materials described as garbage, ashes, and rubbish as defined in this chapter.
The owner, lessee, tenant or other person having the management or control of or occupying any lot or plot of land in the village, excluding any location under the jurisdiction or control of the Village DPW, shall keep his land at all times free and clear of any accumulation of ashes, garbage, offal, animal waste, refuse, rubbish or any other offensive or noxious substances, except as are deposited in a watertight metal or plastic container, secured by a metal or plastic cover and placed for collection and disposal by said DPW or other licensed refuse collector, in accordance with the collection regulations provided for in this chapter.
A. 
It shall be an offense hereunder for any person to deposit, throw, cast or bury ashes, garbage, offal, refuse, rubbish or any offensive or noxious substances on, in or around any public place or street, any vacant lot or plot of land in the village.
B. 
It shall be an offense hereunder for any person to deposit refuse or similar materials accumulated or produced on or about private property in any litter basket placed, owned or maintained by the village upon the public streets, sidewalks or any other public place.
