Metered parking spaces located within any MOPS facility established under the provisions of Article V of this chapter, as designated and described in Schedule XXV (§ 189-76) of this chapter, shall, except as otherwise specifically provided therein, be fully subject to the provisions of this article.
A.
Metered parking shall be deemed to be in force and effect, for the purposes of this article, between the hours of 7:00 a.m. and 6:00 p.m. Mondays through Saturdays, except that when any different hours of operation shall be specified for any metered parking space pursuant to the provisions of Schedule XXIV (§ 189-75) or XXV (§ 189-76) of this chapter or by rule, order or regulation enacted pursuant to the provisions of this chapter and posted in accordance with the provisions of this chapter, such different hours of operation shall apply for the purposes of this article.
B.
Maximum parking time limits during established hours of operation of metered parking shall be as posted on the meter or other traffic control device regulating each metered space. In order to establish the maximum lawful parking time for a particular metered space, the owner or operator of each vehicle entering such space shall immediately deposit and pay into such meter device the fee required to operate such meter as specified thereon and shall activate such meter device in the manner provided or directed by the instructions thereon. Only after the deposit of the required fee and the activation of the meter device as provided herein shall such metered space be lawfully occupied by the vehicle, and the parking time allotted upon compliance with such procedures and indicated upon the dial face of such meter shall be the maximum parking time limit for such vehicle.
C.
No person shall, at any time during established and applicable hours of operation, park or stand any vehicle for any duration in any metered parking space where the meter device regulating such space shall display a violation flag or other expired-time signal thereon.
A.
Every parking meter device installed within the Village and regulating and controlling any designated and delineated parking space shall provide, by suitable and sufficient legend, notice or instruction displayed thereon, the legal parking time limit(s) and the legal fee rate(s) or charge(s) relative thereto established for that particular metered parking space in accordance with the provisions of this section.
B.
Parking time limits and the legal parking fees or charges ratably provided therefor shall be as established from time to time by resolution, rule, order or regulation enacted by the Board of Trustees, which Board may specify and establish different time limits and different charge rates for each particular metered parking space without regard to the uniformity of such provisions within any particular zone, within any particular MOPS facility or within the Village as a whole.
C.
Notwithstanding any other provisions of this article or any other provisions of this chapter, the Board of Trustees or, if duly authorized by resolution of such Board, the Mayor or Superintendent of Public Works is hereby authorized and empowered, by order of such Board or duly designated officer, to temporarily suspend the metered parking regulations otherwise applicable under the provisions of this article or any other article, section or schedule enacted under or pursuant to this chapter, on legal holidays, during snow or other declared emergencies or for and during certain authorized special events, including but not limited to parades, processions or public assemblages, upon such terms and conditions as may be reasonably determined by such Board or officer and set forth in such order to be necessary to protect or preserve the public health, safety, welfare or good order.
