It is hereby declared the policy of the Town of Fort Edward, County of Washington, State of New York, to preserve and maintain the clean character of its environs and to preserve and maintain the health and welfare of its residents within the incorporated area of the town, and in so doing it is necessary to enact this chapter restricting the disposal of waste and litter within the Town of Fort Edward.
For the purposes of this chapter. the following terms shall have the following definitions:
LITTER
Any and all discarded materials, including waste, construction and demolition debris, ashes, garbage, paper, empty containers, rubbish, refuse and other debris of nondescript nature.
MUNICIPAL EMPLOYEE
Any employee or officer of the Highway Department of the Town of Fort Edward, and the Town Code Enforcement Officer or other designated personnel assigned to such Department, whether on a permanent or temporary basis.
PERSON
Any individual, partnership, corporation or unincorporated association, society, joint-stock company, estate, receiver, trustee, assignee, referee and any combination of the foregoing.
PUBLIC PLACE
Any highway, road, street, avenue, alley, park, playground, public parking area, public driveway or any property under the ownership or control of the Town of Fort Edward, or any property serving the general public.
A. 
No person shall dispose of litter or direct or permit any servant, agent or employee, or any other person under his or her control, to dispose of litter of any kind whatsoever in or upon any public place, vacant lot or area within the Town of Fort Edward (outside the Village of Fort Edward limits).
B. 
Every owner, lessee, tenant or occupant or person in charge of any building or premises shall keep and cause to be kept the sidewalk and all areas abutting the building or premises free from obstruction and nuisance of any kind and shall keep said area free of any litter within the Town of Fort Edward (outside the Village of Fort Edward limits).
C. 
No owner, driver, person in control or passenger of any vehicle shall throw or cause to be thrown from said vehicle, whether moving or standing, any litter in or upon any public place or upon any vacant lot or area within the Town of Fort Edward (outside the Village of Fort Edward limits).
No person shall interfere with any municipal employee enforcing this chapter or in the act of cleaning of any road or other public place or area or in the performance of any of the municipal employee's regular or prescribed duties or functions as related to sanitation services performed and enforcement of the local laws and codes of the Town of Fort Edward.
Each violation of this chapter shall be punishable by a fine not exceeding five hundred dollars ($500.) for each offense or by imprisonment for not more than ten (10) days, or by a combination of fine and imprisonment. A violation of this chapter shall constitute disorderly conduct, and any person found to violate the same shall be declared a disorderly person.
