No person on or after the effective date of this chapter shall conduct
or allow to be conducted any outdoor parade or procession without first obtaining
a license therefor, in compliance with the terms of this chapter.
As used in this chapter, the following terms shall have the meanings
indicated:
The occupying or marching on any street of the Town of New Hartford,
to the exclusion or interruption of other citizens and their individual right
and use thereof.
A.
A duly executed application, in writing, on a form furnished
by the Town Clerk of the Town of New Hartford shall be submitted to the Police
Chief of the Town of New Hartford at least seven business days prior to the
parade or procession activity.
B.
Such application must secure the approval of the Police
Chief by his duly authorized signature affixed thereto.
C.
Said application shall contain the object, time and route
of such parade and/or procession.
A.
Said application, having contained the object, time and
route of such parade or procession, shall be subject to the designation of
such parade or procession by the Police Chief of the Town of New Hartford,
and the Police Chief shall be responsible that the designation is obeyed.
B.
If there be any costs incurred for arrangements for traffic
or crowd control, such costs shall be borne entirely by the applicant.
C.
Violations of the conditions of this license shall render
the license null and void, constitute a violation of this chapter and subject
the licensee to the penalties provided in this chapter.
If such requested parade or procession shall be for a charitable, religious
or philanthropic purpose and exemption is sought from the provisions of this
chapter, upon a sworn application setting forth the name and address of the
person and/or organization, the period which the parade or procession is to
be conducted, a specific statement of the charitable, religious or philanthropic
purpose and the relationship between the parade or procession and that stated
purpose, and if the Police Chief is satisfied that the stated purpose is charitable,
religious or philanthropic, he shall so notify the applicant, in writing,
and shall allow the exemption.
The license fee is hereby established at $25, unless otherwise determined
by the New Hartford Town Board.
Any person who shall violate any provision of this chapter shall be
guilty of a summary offense and shall be fined a sum not to exceed $250 for
each violation.
