The purpose of this article is to establish a special district for the Estates Drive Railroad Crossing.
A. 
The Town of New Hartford hereby establishes, by local law, a special district to finance the purchase of a permanent easement across the N.Y.S.& W. Railroad Corporation property on Estates Drive in the Town of New Hartford for the sum of $45,000.
B. 
The Town of New Hartford shall bond for the purpose set forth herein and will charge a special assessment for each member of the Fairway Estates Homeowners' Association, Inc., to cover the entire cost of the bond. Any unpaid assessments will become a lien on the real estate of Fairway Estates homeowners property and be subject to collection and foreclosure procedure provided by Article 9-B, Condominium Act, of the Real Property Law of the State of New York or any other law applicable to special districts.
