Each and every restaurant located in the Town,
as identified, as licensed and as inspected by the Oneida County Department
of Health and/or the New York State Department of Agriculture and
Markets, shall, within one year of the adoption of this article, cause
to be installed an operating grease trap, to which all grease and
grease-containing liquids generated by the restaurant in the normal
course of business shall be directed.
A.
The licensee of the restaurant shall, on a regular
basis, cause the grease in the grease trap to be removed and disposed
of by other than being discharged into the municipal sewer.
B.
The Town shall, on a biannual basis, have the grease
trap inspected for its condition and, if more than 3/4 full,
shall notify the licensee that the trap is to be cleaned within 24
hours. Should the Town determine that the grease trap is full during
any inspection, the licensee shall be immediately informed of the
situation, and the licensee shall have the trap cleaned within eight
hours. Failure to have the trap cleaned within eight hours following
notification shall result in a fine of $500 for violation of this
article, in addition to the right by the Town to immediately close
the restaurant facility and to recover any and all costs incurred
by the Town, including labor and materials, to have the grease trap
emptied and cleaned. Such remuneration shall be due the Town within
30 calendar days following the invoice date by the town.
C.
Should the Town determine that the condition of the
grease trap is creating or contributing to a health problem or potential
health problem, to include but not be limited to emanating objectionable
odors, or causing or having the potential to cause sewage to back
up into the licensee's property or the property of others, the licensee
shall be notified and shall have a maximum of two hours following
notification to have the trap and connecting lateral cleaned of grease.
Failure of the licensee to respond within the time period so stated
shall result in a fine of $500 for violation of this article, the
right of the Town to close the restaurant facility, and the right
of the Town to receive remuneration from the licensee for any and
all costs incurred, to include materials and labor, in the cleaning
of the grease trap and connecting lateral. In addition, should the
Town determine that grease discharged from the restaurant facility
is causing a sewer blockage in the sewer main and other connecting
laterals, the Town shall have the right to remuneration for any and
all costs incurred for the opening of any blocked sewer main and adjoining
laterals. All remuneration mentioned in this section shall be due
the Town within 30 calendar days of the date of the invoice to the
licensee.
