GENERAL REFERENCES

The Board of Supervisors hereby ordains and creates a Park and Recreation Board hereinafter to be known as the "Park and Recreation Board of Lower Providence Township" (hereinafter referred to as "Board").

The Board hereby created shall have a membership of nine individuals, and the term of office shall be five years, except for the original appointments, which shall be in the manner set forth below:
A. 
Appointment of members. The Board of Supervisors shall appoint the members of the Board. Appointment shall be by resolution.
B. 
Qualifications of members.
(1) 
All individuals appointed to the Board shall be residents of Lower Providence Township at the time of their respective appointment.
(2) 
In the event that a member moves his or her residence from the Township aforesaid, the position shall be declared vacant, and said vacancy shall be filled by the Board of Supervisors.
C. 
Staggered terms. To assure continuity within the membership of the Board, the following schedule of original appointments shall be made:

Compensation. All Board members shall serve without pay.
E. 
Vacancies. In the event of any vacancy or vacancies by reason of death, resignation or failure to perform the duties of a member of the Board, such vacancy or vacancies shall be filled by the Board of Supervisors. The appointment to fill such vacancies shall be an interim appointment to fill the unexpired term of the deceased, resigned or disqualified member.
Immediately after appointment of members of the Board, the said members shall meet and elect a Chairman and Secretary and such other officers as the Board may deem necessary for the operation of the Board.
A. 
Term. The officers elected by the Board shall hold the position for one year.
B. 
Meetings.
(1) 
The organizational meeting of the Board shall occur at the first meeting of the Board in the month of January of each year.
(2) 
The Board shall hold regular meetings and designate the time and place thereof and shall keep minutes of all its proceedings.
(3) 
At its first meeting in January of each year, the Board shall determine the existing insurance policies for all park and recreation facilities, determine if these recreation facilities are sufficient and report to the Board of Supervisors thereon with recommendations, if any, for changes in coverages or amounts.
C. 
Quorum. At any meeting of the Board, a quorum shall be five of the nine members, and no motion, resolution or action shall be deemed approved unless or until it has the affirmative vote or approval of five members.

D. 
Attendance.
(1) 
A vacancy or disqualification shall be deemed to occur when any duly appointed member shall fail to attend three consecutive regular meetings or 25% of all such meetings within the calendar year.
(2) 
Such absences shall be excusable by the Board upon presentation to the Board of reasons therefor, which explanations shall be entered in the record of minutes of the Board.

The Board shall serve in an advisory capacity to the Board of Supervisors of Lower Providence Township; shall work with the Director of Parks and Recreation in reviewing and developing policies pertaining to all municipal and school park recreation matters; shall review and recommend, with the Director of Parks and Recreation, Board of Supervisors and School Board Directors of Methacton School District (where appropriate), proposals of development of recreation facilities, programs and improved recreation services; shall make recommendations concerning a comprehensive system of recreation and park areas, facilities and programs to meet the anticipated needs of the township; and shall cooperate with any and all governmental agencies and civic organizations for the purpose of furthering the implementation of the comprehensive system of parks and recreation developed by said Board.
A. 
The Board, through its duly elected or appointed officers, shall submit an annual report at the close of the calendar year to the Board of Supervisors of Lower Providence Township.
B. 
Text of report. Said annual report shall consist of the following:
(1) 
A full list and description of all community park and recreation facilities and equipment within the township.
(2) 
Analysis of community park and recreation facilities.
(3) 
Analysis of program leadership.
(4) 
Analysis of adequacy and effectiveness of program.
(5) 
A financial report of all moneys spent by Board.
(6) 
A detailed list of all contracts entered into and the purpose of each.
(7) 
A list of all insurances, indicating:
(a) 
Type of coverage.
(b) 
Number of policy.
(c) 
Name of company.
(d) 
Name of agent, if any.
C. 
Additional reporting. In addition to the annual reporting referred to above, the Board shall immediately report to the Board of Supervisors the full detail of any of the following occurrences:
(1) 
Injury or death to any person utilizing any community park and recreation facility.
(2) 
Casualty loss to any facility or portion thereof by:
(a) 
Fire.
(b) 
Theft.
(c) 
Vandalism.
(d) 
Act of nature.
(3) 
Litigation to any court involving a claim, real, supposed or asserted, against the Board or any member thereof acting in his or her Board member capacity.
A. 
This chapter creating the Park and Recreation Board of Lower Providence Township shall become effective immediately after enactment.
B. 
Upon the effective date of this chapter and by these presents, the Board of Supervisors of Lower Providence Township does hereby grant unto the Board created herein the care, custody, control, maintenance and operation of all township-owned community, park and recreation facilities.
