Whenever any of the following words are used in this article, they shall have the respective meanings as follows:
CHAINS
Full chains, strap chains or other types of chains mounted on the rear wheels (or the front wheels of a front wheel drive) of a motorized vehicle.
EMERGENCY COORDINATOR
Any Township employee designated from time to time by the Township Manager as the Emergency Coordinator.
SNOW
Any precipitation depositing any accumulation of snow, sleet, hail, ice or freezing rain on the streets of the Township.
SNOW EMERGENCY
A state of highway conditions that are hazardous and dangerous to vehicular and pedestrian traffic and so declared by the Emergency Coordinator.
SNOW TIRES
Tires having treads designed for use in snow, which tires must be in such condition as to serve the purpose for which they are designed.
VEHICLES
All self-propelled motorized vehicles using Township streets and highways, including taxicabs, but excluding other public transportation conveyances.
Between November 1 and March 31 of each and every calendar year, no vehicle shall be parked on the odd numbered, postal address side of any street or road in the Township when snow, as defined in § 138-27, starts to fall, unless there shall be no off-street parking available at or within 300 feet of the residence property owned, occupied, used or visited by the operator or possessor of such vehicle or business establishment.
A. 
When, in the opinion of the Emergency Coordinator, the actual or expected precipitation of snow will create hazardous or dangerous highway conditions for vehicular or pedestrian traffic, he shall have authority to declare a "snow emergency."
(1) 
The Emergency Coordinator shall immediately inform the public of the snow emergency by issuing a press release to the local radio and news services.
(2) 
The snow emergency shall continue in force and effect until the Emergency Coordinator declares it to be over in the same manner as provided for in Subsection A(1).
B. 
One hour after a snow emergency has been declared and during its existence:
(1) 
Any person who drives a vehicle without chains or snow tires upon any street or road within the Township (except for the purpose of removing it from said street or road), and allows such vehicle to become stalled or incapable of moving under its own power, or who leaves such vehicle unattended, shall be in violation of this article and shall be subject to the penalties hereafter set forth.
(2) 
Any vehicle parked, stalled, incapable of moving under its own power or left unattended upon any street or road of the Township may be removed or towed away to any other location by the Police Department or any person authorized by the Emergency Coordinator.
(3) 
The Emergency Coordinator may declare any street or road of the Township to be free from the restrictions herein imposed, when in his opinion the weather or street conditions warrant such an exclusion. The Emergency Coordinator shall give notice of his determination in the manner provided for in Subsection A(1).
No person shall deposit snow, as defined in § 138-27, or have snow deposited, upon any street or road in the Township.
Any person who shall violate any provision of this article shall, upon conviction thereof, be sentenced to pay a fine of not more than $50, plus costs of prosecution.
