[HISTORY: Adopted by the City Council of the City of Long Branch 9-28-1976 by Ord. No. 832 (Sec. 18-10 of the 1971 Code). Amendments noted where applicable.]
All unused or abandoned cesspools, septic tanks, seepage pits, privies or other places used for the reception or storage of human excretion shall be pumped out and filled to the level of the surrounding earth with clean earth within two years after the connection with the public sanitary sewer system or after abandonment or disuse.
A certificate shall be secured from the Board of Health of the city showing approval by the person designated by the Board of Health certifying that the requirements set forth in § 140-1 have been met.
All presently existing unused or abandoned cesspools, septic tanks, seepage pits, privies or other places used for the reception or storage of human excretion shall be pumped out and filled to the level of the surrounding earth with clean earth within two years from the adoption of this chapter.

Any person, persons, firm or firms violating this chapter shall, upon conviction thereof, be punishable as provided in Chapter 1, General Provisions, Article I. Each day any violation or neglect is committed or permitted to continue under this chapter shall constitute a separate offense and be punishable as such.
